I I I I I I I 1o I I CASE # 4 REQUEST FOR A CONDTIONAL USE PERMIT RENEWAL FOR MINING OPERATIONS; CASE OF BARTON SAND AND GRAVEL, INC. By: Zoning Administrator Sylvia Frolik Background: On August 25, 1987, the City issued a conditional use permit to Barton Sand and Gravel to extract aggregate from property located in the northeast corner of the Cty. Road #116 and Cty. Road #56 intersection. That permit expired on December 31, 1992 and Barton has applied for a renewal. The following items are enclosed for your information: a) b) c) d) e) Site location map Grading Plans (1987) Letter from City Engineer Jankowski to Barton Sand and Gravel dated 1/27/93 Proposed findings of fact Proposed conditional use permit Observations: The grading plans that were submitted with the application are the same that were reviewed by the City when thc permit was first granted in 1987. Although there has only been a very small amount of aggregate removed from the property to date, the grading plans should be updated per the City Engineer's letter of January 27, 1993. These updated grading plans should then be reviewed by DNR because of the proximity of the protected wetland. Recommendation: City Staff recommends approval of the permit contingent upon submittal of updated grading plans that receive favorable reviews by the City Engineer and DNR. Commission Action: Motion to: Reco mend that City Council adopt Findings of Fact # relating to Barton Sand and Gravel s request for a condiuonal use perrmt renewal to conunue m~nmg operanons. Motion to: Recommend that City Council approve/deny Barton Sand and Gravel's request for a conditional use permit renewal for minining operations contingent upon submittal of updated grading plans.
