I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT AMENDMENT; <br />CASE OF DANNY'S ALUMINUM PROCESSING, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may recall, in September of 1992 you reviewed and recommended approval of a <br />conditional use permit amendment and site plan for Danny's Aluminum Processing, Inc. The site <br />plan consis[~d of construction of a new building to accommodate operations expansion and the <br />conditional use permit amendment was to allow for the disassembly of engines and transmissions <br />and acceptani:e of other non-hazarouds metals within the new building. That case was forwarded <br />to City Council where it was denied based on the concern that an expansion of the facility is not <br />appropriate vi, hen Mr. Karst seems to have difficulty complying with the terms of the conditional <br />use permit for the facility in its current size. <br /> <br />In December .the City Council received complaints of continued non-compliance on the part of Mr. <br />Karst and Ci~ Staff was directed to initiate action necessary for Council to consider revocation of <br />the conditional use permit. In accordance with City Code procedures, I inspected the facility and <br />sent Mr. Kanst a letter on December 3 which described the violations and gave him 30 days to <br />correct the viblafions or a public hearing would be scheduled to consider revocation. On January <br />6, 1993, I inspected the site as a finality to the the 30 day time frame. Mr. Karst was in <br />compliance With his conditional use permit. This information was provided to City Council on <br />January 12 and they ceased proceedings to consider rovocation of Mr. Karst's permit. <br /> <br />At the January 12 Council meeting, Mr. Karst was present and explained that in order to be in <br />compliance with his conditional use permit, he had to shut down the engine and transmission <br />disassembly line and lay off the employees on that line. He requested that City Council reconsider <br />a conditionaFuse permit amendment to allow for the disassembly of engines and transmissions <br />based on the.fact that a similar facility in Ramsey is permitted to do so and in order that the <br />employees e0ald be placed back on the payroll. Council directed City Stiff to proceed to work <br />with Mr. KarSt for a conditional use permit amendment as expeditiously as possible. <br /> <br />Observations: <br /> <br />On December 1, 1992, I inspected Danny's Aluminum Processing, Inc. <br /> <br />On December 3, 1992, I sent a written notice of the violations found on December 1 to Mr. Dan <br />Karst and gave him until January 5, 1993 to make the corrections. I also sought the assistance of <br />Minnesota POllution Control Agency (MPCA) and Anoka County Environmental Services to <br />inspect the facility for compliance with those terms that I felt I was not qualified to address. <br /> <br />On December 11, 1992, Fereshteh Rahimzadeh of MPCA inspected Danny's Aluminum <br />Processing fa¢ility. Her verbal comments to me were that she observed the facility for a couple of <br />hours prior to approaching Mr. Karst for an on-site inspection and that she had no violations to <br />report. <br /> <br />On December :21, 1992, Duwayne Konewko of Anoka County Environmental Services inspected <br />Danny's Aluminum Processing, Inc. In summary, Mr. Konewko was impressed with the extent <br />to which Dantiy's Aluminum Processing is in compliance, with State and County environmental <br />regulations. He also provided me with a copy of OSHA s inspection report dated October 28, <br />1992. The report indicates that there were some violations that were classified as non-serious that <br />have been eorr~.eted. The employees were also monitored for exposure to air and noise pollutants; <br />there were no violations. <br /> <br /> <br />
