I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br /> <br />On Decemb.er 30, 1992, at the request of Mr. Karst, I did a follow up inspection of the aluminum <br />processing0peration. Again I documented my findings and a substantial amount of effort had <br />been put forfl~ my Mr. Karst to get into compliance with his conditional use permit. <br /> <br />On January 6, 1993, I inspected Danny's Aluminum Processing, Inc. as a finality to the 30 day <br />time frame given to correct the violations. Mr. Karst was in compliance with his conditional use <br />permit. With regard to Lots 2, 3 and 4, all buses had been removed, and most of the other debris <br />had been removed or was in the process of being removed. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />g) <br />h) <br /> <br />Current Conditional Use Permit <br />Inspection report dated December 1, 1992 by Sylvia Frolik <br />Letter from Sylvia Frolik to Dan Karst dated December 3, 1992. <br />Inspection report dated December 30, 1992 by Sylvia Frolik <br />Report from Duwayne Konewko, Anoka County Environmental Services, dated <br />January 5, 1993. <br />Inspection report dated January 6, 1993 by Sylvia Frolik <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />In lieu of this being a simple amendment to allow for the disassembly of engines in the existing <br />building, bas~ically the same conditional use permit that is in effect now is proposed to be issued <br />with the following modifications: <br /> <br />#7 was modified to reflect the current situation as it pertains to MPCA approval of <br />the afterburners. <br /> <br />b) #10 was modified to permit the disassembly of engines and transmissions. <br /> <br />c) <br /> <br />#11, #12, #13 and #14 were added to address issues that relate to disassembly of <br />engines and transmissions. <br /> <br />d) #17 was added to clarify permitted uses on Lots 2, 3 and 4. <br /> <br />#19 was modified to maintain control without jeopardizing confidentiality (it seems <br />ash recipients are difficult to find and if you find one you want it kept confidential <br />for competitive reasons). <br /> <br />Those items in the current CUP dealing with building permits and electrical codes <br />were deleted as this particular proposal does not include building expansion. <br /> <br />g) <br /> <br />#29 was modified to require participation in a public improvement project if and <br />when it happens rather than to require petitioning for the improvements within 30 <br />days (which had been tried and the petition failed). <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the request. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt findings of fact relating to a request for a conditional <br />use permit amendment from Danny's Aluminum Processing, Inc. <br /> <br />-and- <br /> <br /> <br />
