CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION; <br />CASE OF DIANE DEMPSEY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Diane Dempsey, a soon to be resident of 14794 Krypton Court N.W., has applied for a conditional <br />use permit for a home occupation. Diane would like to transfer her porcelain doll-making classes <br />from her home in Maple Grove to her new home in Ramsey. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br /> <br />Site location map <br />Applicants letter of application <br />Site plan <br />Floor plan <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Observations: <br /> <br />In accordance with the City's regulations for home occupations, the area devoted to the business <br />would not exceed 20% of the total floor area of the home. The employees would be restricted to <br />the residents of the home. The driveway is marginally large enough to provide a sufficient amount <br />of off-street parking for the students. In order to avoid the need for on-street parking, Diane <br />indicates in her letter of application that she would restrict the class size to 6 students and many of <br />the students would continue to car pool. At this time, she is proposing 4, 2.5~hour classes, 3 <br />evenings and 1 afternoon, per week. <br /> <br />It should be noted that Diane's home is the first to be developed on Krypton Court N.W. <br />Therefore, her future neighbors will not have had the opportunity to comment on the request for a <br />home occupation as the hearing notices were mailed to the developer of Wood Pond Hills 3rd <br />Addition, the current owner of the surrounding parcels. <br /> <br />Recommendation: <br /> <br />In lieu of the site location being an urban size lot in the Urban Residential District, and in lieu of the <br />absence of neighbors to comment on the request, City Staff is recommending that an interim use <br />permit be granted to accommodate the classes for approximately one year after Diane takes <br />occupancy of the home. At the end of one year, the classes should be relocated to an appropriate <br />commercial location or Diane should request converting the interim use permit to a conditional use <br />permit. City consideration to convert the interim use permit to a conditional use permit would <br />require a new public hearing by the Planning Commission and a decision of the City Council. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt Resolution #94-05- adopting Findings of Fact <br /># relating to a request for a home occupation permit at 14794 Krypton Court N.W. <br /> <br />-and- <br /> <br /> <br />
