Case #l: <br /> <br />Conduct Public Hearing 'and :Consider Adoption of Ordinance to Amend <br />Certain Sections Of the City Charter <br /> <br />Mayor Gamec closed the regular portion of the ;City Council meeting at 7:40 p.m. in order to <br />conduct a public hearing. <br /> <br />Public Hearing <br /> <br />Mayor Gamec called the public hearing to order at 7:40 p.m. <br /> <br />Presentation <br /> <br />City Attorney Goodrich advised the Charter Commission met on September 30, 2004, and <br />considered certain housekeeping or minor amendments to the City Charter. These amendments <br />became necessary as a result of the Charter amendments increasing the Council size to seven <br />members and adoption of the Ward System. ThelChapters 3 and 4 amendments are necessitated <br />by the increase of the Council from five to seven members. The Chapter 5 amendments deal <br />with the recall section and provide for recall to be conducted only within the ward represented by <br />the subject Councilmember. The City Charter Can be amended by the ordinance procedure as <br />provided in State statute. This procedure requires that the Charter Commission recommend the <br />ordinance to the Council; that the Council conduct a public hearing preceded by two weeks <br />publication of the proposed ordinance; that the ordinance be passed unanimously by the City <br />Council and that the ordinance not become effective for a period of 90 days after publication in <br />order to permit citizens to petition to have a referendum on the ordinance. The Council voted to <br />introduce this ordinance and schedule a public hearing for November 9th to consider adoption. <br />Staff published the notice of public hearing and the entire ordinance that was introduced in the <br />City's official paper. He advised the vote will need to be tabled, as all Councilmembers must be <br />present. <br /> <br />Citizen Input. <br /> <br />The Chairperson for the Charter Commission inquired if the Council has any concerns about the <br />wording that they would like the Charter Commission to address at its next meeting. <br /> <br />Mayor Galnec replied there may be some minor things the City Attorney would change, but there <br />is nothing major that needs to be addressed. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Kurak, Pearson, and <br />Strommcn. Voting No: None.
