Motion carried. Case #8: Request for Approval of the Development Permit Relating to the Final Site Plan for the Developmen~ of Lot 1, Block 1, Ramsey Town Center 3rd Addition; Case of Ramdanee, LLC Community Development Director Frolik eXplained Case No. 8 and Case No. 9 will be reviewed together, as the applicant has requested merging ithe two agreements into one document. The document has been reviewed by City Attorney Goodrich, Assistant Public Works Director Olson, and Sbingobee Development, and is down tO one unresolved item relating to stormwater. Assistant Public Works Director Olson exPlained the reason they had initially put this in was due to stormwater that is discharging not only into the southwest pond, which has been reconfigured, but also into the Mississippi Rive?. The condition of the final plat approval was that all lots subject to final plat approval within TOwn Center shall have pretreatment in Best Management Practices to try to infiltrate the water and treat the Water quicker than what generally happens in a regional treatment system. In the case of Ramsey Town Center 2nd Addition, D. R. Horton, it was decided to utilize a rain garden. That has not exactly been proven in staff's opinion, but it was determined to give it a try. He explained the issue is basically that Shingobee Development has some concern with the stormceptor not only handling this site, but also adjacent runoff from the county road upgrades that are necessary as part of the final plat that was approved. He stated staff does not care who pays for the improvement, but the City should not have that responsibility. Greg Voss, representative of Shingobee Development, stated the stormceptor came to their attention this afternoon for the first time as an engineering drawing. The biggest concern is the design and redesign of the storm Pond was to create a water treatment process to create better water quality, along with creating more density and tax base, and to accomplish both by redesigning it. He stated 50 percent or more of the water that comes into the pond comes from off of the RTC plat through the property to the West of Armstrong Boulevard. They have a concern that this is being addressed for their third addition plat as their sole responsibility to treat all that water. There are actually three pipes thatflow into the pond. He stated he would like an opportunity of finding a better resolve for that. Shingobee Development does believe in water quality and in their design there are catch basins and oil separators throughout the plat. He is a little off guard and does not have a handle on this Stormceptor, but he does not feel now that this plat is responsible for all the stormceptor for all: of the water offsite. He stated their plat only generates approximately 30 percent:of the water gOing into that pond. Mayor Gamec asked if this could be approVed contingent on the Engineer Agreement. He noted there is drainage that will come from several different areas, Assistant Public Works Director Olson indicated he understands the concern of Ramsey Town Center 3rd Addition. His thoughts are that the agreement at the time the final plat was signed was that there would be ponding and water qualitY treatment for all of the improvements necessary as part of the final plat approval, those being county road improvements.
