part of the overall Town Center plat and that was a definite responsibility of the master developer <br />to create the mass grading and have the regional istormwater ponds. The amount of volume of <br />water that can be held within this site has 'been decreased, because it was redirected off the <br />southwest pond. This is due to an issUe during review that the pond should be an amenity and <br />not functional. There was also not enough room on the site to put what Cobum's had suggested <br />they wanted to put on the site, so there was .some give and take. He advised the City did receive <br />a letter agreeing to the terms of a change order for Sunwood Drive that the Council will see later <br />in the agenda that the developer has agreed' to pay, but they do not really have anything that ties <br />anyone into constructing this stormwater manhole. If they do not do this now they do not have <br />the ability to do it for the next phase that comes i,n. Staff is taking the position that it has to be <br />done. Ite suggested Town Center 3rd Addition and the master developer may be able to work out <br />a prorated share. It is included in the improvement requirements and was mentioned at the last <br />Council meeting as a contingency t° the final plat approval. <br /> <br />Councilmember Cook asked what the cost is for the stormceptor. <br /> <br />Assistant Public Works Director Olson replied the cost is approximately $35,000. He explained <br />he does not want to make the determination to say the master developer is responsible for a <br />certain percentage of the cost. This is a Best Management Practice for this final plat approval <br />that has been discussed since day:One with regards to Mr. Voss at construction meetings, and it <br />was included in the language at the last meeting when Mr. McDonald was present. <br /> <br />Mr. Voss stated their construction engineer estimated the cost in excess of $90,000, which is <br />significantly more than $35,000. :His concern in.short order is not about water quality, it is the <br />fact that all along they have known 50 percent ormore of the water will be generated from the <br />west of Armstrong Boulevard, not because of this.project, but because of the lay of the land and <br />how the water flows. <br /> <br />Mayor Gamec suggested the agreement be approved contingent on Engineering working out an <br />agreement with the developer. <br /> <br />Assistant Public Works Director Olson stated what he is hearing Shingobee Development say is <br />they are not willing to pay for treatment off-site,: and what he is saying is the water needs to be <br />treated for the improvements to the final plat that were approved. In his opinion land west of <br /> rd <br />Armstrong Boulevard is not generating water through the Ramsey Town Center 3 Addition site. <br /> <br />Mr. Voss stated for the third addition to solely and exclusively pay for all storm water treatment <br />is not right. <br /> <br />Assistant Public Works Director Olson stated:if there is drainage through this site coming from <br />west of Armstrong Boulevard, other than what Was anticipated coming from the west and the <br />northwest, he would bring back a resolution at the next Council meeting to ask for the City to <br />participate in whatever the percentage of that water is.
