Ootmcilmember Elvig inquired how challenging it will be to obtain a joint drainage easement. <br /> <br />Assistant Community Development Director Trudgeon replied notice has been received from the <br />adjacent property owner Dennis Sharp that they would be willing to work with the City and the <br />adjacent property owner. If the Council is inclined he would suggest a motion to approve <br />contingent on the City Staff Review Letter dated September 10, 2004, revised October 8, 2004, <br />revising the grading and drainage plan to be in compliance with City standards, and contingent <br />on the drainage and utility easement being worked out by the property owners concerning the <br />pond on the adjacent property prior to issuance of a Certificate of Occupancy. <br /> <br />Motion by Councilmember Pearson, seconded by Councilmember Elvig, to approve the proposed <br />site plan contingent upon compliance with City Staff Review Letter dated September 10, 2004, <br />revised October 8, 2004, revising the grading and drainage plan to be in compliance with City <br />standards, and contingent on the drainage and utility easement being worked out by the property <br />owners concerning the pond on the adjacent property prior to issuance of a Certificate of <br />Occupancy. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #5: <br /> <br />Request for Site Plan Review for CNP Storage; Case of TSM Development, <br />INC <br /> <br />Associate Planner Geisler indicated this case is related to Case No. 6 and she will be discussing <br />the cases together. She explained TSM Development, Inc. has submitted a site plan to develop a <br />mini-storage facility on 4.8 acres on Outlet A of Regency Pond. A major subdivision is being <br />processed along with the site plan to replat Outlet A. The Planning Commission reviewed the <br />site plan at their July 1st and July 12th 2004 meetings, along with a subdivision request to replat <br />Outlet A of Regency Pond. She explained TSM Development, Inc. is proposing to construct a <br />19,440-, 15,200-, 10,200-, and a 15,600-square foot storage building on Outlet A of Regency <br />Pond. The proposed development is located in the E-1 Employment District; mini-storage <br />facilities are a permitted use in this district. <br /> <br />Associate Planner Geisler advised the lot coverage has been calculated at nine percent, which is <br />under thc 45 percent maximum lot coverage restriction established in City Code. Under City <br />Code the proposed development must establish a 60-foot buffer yard, with increased plantings, <br />along all residentially zoned properties; the site plan is showing an adequate buffer yard on the <br />eastern border but not on its northern border. She indicated the most current landscaping plan is <br />still significantly deficient in terms of shrubs, most notably in both the buffer yards to the north <br />and cast. At the July 1st meeting the Planning Commission recommended a privacy fence <br />between the proposed development and the residential properties to the south, east, and north. <br />The site plan currently shows an 8-foot chain link fence. The proposed site plan received its <br />WMO permit approval on September 16, 2004. WMO approval contained several conditions, <br />including thc addition of additional 'dead storage' on the Subject Property, and verification that <br />thc lowest floor elevations of adjacent homes in Regency Pond are two feet above the 100-year <br /> <br />City Council/October 12, 2004 <br /> Page 16 of 30 <br /> <br /> <br />
