27, 2004. The final adoption of the ordinance amendment to allow for fuel sales in the TC-2 <br />District is also on tonight's agenda. She explained City Code states that there shall not be more <br />than one main building on a lot. On August 5, 2004, the Board of Adjustment granted the <br />applicant a variance to develop the property with multiple buildings. The TC-2 District <br />establishes a .5 floor area ratio. On July 12, 2004, the Board of Adjustment granted a variance to <br />the .5 floor area ratio requirement. <br /> <br />Community Development Director Frolik indicated the maximum front yard setback in the TC-2 <br />District is 0-15 feet. The store is proposed to be located at the south boundary of the site, <br />approximately 300 feet back from the Sunwood Drive right-of-way. The Town Center <br />Development Guidelines encourage placement of larger scale buildings along the railroad. On <br />July 12th, the Board of Adjustment approved the applicant's request for a variance to the front <br />yard setback requirement. She advised a total of 440 parking spaces would be required for the <br />uses ultimately proposed for Lots 1 and 2; the site plan is showing 489 spaces. The grading and <br />utility plans have been reviewed by the Engineering Department and required modifications are <br />listed in the Staff Review Letter dated October 7, 2004. Staff has reviewed the landscape plan. <br />The plan must be modified to include an additional 24 trees and incorporate other con'ections <br />outlined in the Staff Review Letter dated October 7, 2004. The final site plan identifies a trash <br />compactor on the south wall of the building. This is also the proposed location for the trash <br />container. The site plan must be modified to indicate what type of enclosure and construction <br />materials will be used to screen the trash storage area. The final site plan submittal did not <br />include a lighting plan. The lighting plan must be submitted to the City for review and approval. <br /> <br />Community Development Director Frolik stated the project generally conforms to the Town <br />Center Development Guidelines. She indicated the building elevations have not been updated <br />since Preliminary Site Plan approval. The calculations for exterior material finishes will have to <br />be updated when final elevations are prepared. The Council may want to make the approval <br />contingent on this being brought back before the Council. Staff has recommended another <br />revised motion for this final site plan. <br /> <br />Assistant Public Works Director Olson advised regarding gas operations, based on Council <br />direction at thc time of preliminary plat approval, the TC-2 Zoning District Ordinance has been <br />redraftcd to allow for accessory gas operations under Item C, which is outlined on page 267 and <br />306 of the Council packet. It has been amended to state "Overfill protection including automatic <br />shutolT devices, overfill alarms and ball float valves". He explained there is some discussion <br />about whether ball float valves are correct. This language was taken from the MPCA. The <br />MPCA has allowed other mechanisms, and staff is recommending that this be changed to state <br />"Overfill protection including automatic shutoff devices, overfill alarms and ball float valves or <br />approved equal". In addition it is recommended that Item E be changed to state "Product release <br />monitoring, including installation of groundwater monitoring wells and monthly monitoring of <br />these wells will be required .only after a reportable leak or spill has been detected". He explained <br />this ~nonitoring would be required if there is a spill or leak, but there is actually two levels of <br />protection for each type of thing.
