Case #12: <br /> <br />Amendment to the TC-2 Zoning District Regarding Allowing Accessory Gas <br />Operations, Case of Ramdance LLC <br /> <br />Assistant Comlnunity Development Director Trudgeon explained Ramdance LLC has submitted <br />a site plan to construct their first phase of commercial buildings in the Ramsey Town Center. <br />Part of the first phase will consist of a grocery store with an accessory gas operation. The <br />property to be developed is zoned TC-2. Under the TC-2 Zoning District regulations, gas <br />stations are not permitted. It was determined by the Planning Commission and City Council that <br />limited gas operations would be acceptable as shown on the concept plan for Ramdance's <br />commercial development as long as the TC-2 District was amended to allow for it. Before the <br />Council is the revision to the TC-2 District to allow for gas operations. Changes have been made <br />based on Council direction. He advised staff specifically made changes in increasing the amount <br />of gross sales allowed from 10 percent to 5 percent, added the word "franchise" when defining <br />fast food operations, and clarified the language defining the amount of fueling areas to allow for <br />threc ishmds and six dispensers. The proposed amendments should include the changes <br />addressed by Assistant Public Works Director Olson during the discussion of Case No. 9 <br />concerning Item C and Item E. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Pearson, to adopt Ordinance <br />#04-41 adopting an. amendment to the TC-2 Zoning District to allow for accessory gas uses <br />subject to certain performance standards, including the proposed changes to Item C and Item E as <br />follows: <br /> · Item C to state: "Overfill protection including automatic shutoff devices, overfill alarms <br /> and ball float valves or approved equal". <br /> · ltem E to state: "Product release monitoring, including installation of groundwater <br /> monitoring wells and monthly monitoring of these wells will be required only after a <br /> reportable leak or spill has been detected". <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councihnember Cook: aye <br />Counci hnember Elvig: aye <br />Councilmember Kurak: aye <br />Counci hnember Pearson: aye <br />Councilmember Strommen: aye <br />Councihnember Zimmerman: aye <br />Mayor Gamec: aye <br /> <br />Motion carried. <br /> <br />City Council/October 12, 2004 <br /> Page 26 of 30 <br /> <br /> <br />
