thc City, such as the Gun Club and Honey Farm that are petitioning for City sewer and water at <br />this time. <br /> <br />Assistant Public Works Director Olson responded in the affirmative. He explained the map Mr. <br />Hendriksen has shows petitioning property owners that have asked for sewer and water. <br /> <br />Mr. Hendriksen stated Chapter 8 of the City Charter states that all local improvement projects <br />shall be carried out exclusively under the provision of this Charter. He questioned if a public <br />hearing has been held or will be held on the feasibility study. <br /> <br />Assistant Public Works Director Olson replied a public hearing has not yet been held. He <br />explained this is not an assessment project. <br /> <br />Mr. lfendriksen questioned if there are plans to assess any portion of this to the public. <br /> <br />City Attorney Goodrich indicated there would be a public hearing. There will have to be the <br />initial public hearing, and then if it is a 100 percent petition it will go directly into the contract. <br />If it is not a 100 percent petition there will be a 60-day waiting period under the Charter. Under <br />thc Charter, all public improvements are done pursuant to Chapter 8 of the City Charter, <br />supplemented by Chapter 429 of the City Code. He indicated these are all questions that will be <br />responded to based on Mr. Hendriksen's written submittal today. <br /> <br />Mr. lqcndriksen stated the reason he is asking these questions is because there is a process in the <br />City Charter for petitioning for and against this, and it sounds like the City is not going to go <br />through that because it is the City's position that no one is opposed to this. <br /> <br />City Attorney Goodrich explained if there are properties that will be assessed who have not <br />petitioned, there will be the 60-day waiting period. <br /> <br />Mt'. l-lendriksen stated if there is ever any desire or intention to collect a special assessment or <br />anything like that, the lines on the map goes past a great number of properties that are not . <br />petitioning. He would argue that the sudden raising of the trunk charge looks like a camouflaged <br />special assessment. <br /> <br />Assistant Public Works Director Olson explained the current trunk rate is the 2004 rate put into <br />effect in the beginning of the year. The reason the rate was proposed to go up was that there are <br />some changes to the 1991 comprehensive sewer plan that served the exact area that it was <br />suggested would be serviced eventually in the revised comprehensive plan. There is also some <br />aerial topography information that was recently done, which was one of the drivers for updating <br />the comprehensive plan with the better information. It was found that a lot more lift stations <br />would be necessary, which is the reason for the increase in sewer fees. <br /> <br />Mayor Gamcc indicated this will need to be discussed later in the evening or Mr. Hendriksen can <br />come Jn to discuss this with staff. <br /> <br />City Council/October 12, 2004 <br /> Page 4 of 30 <br /> <br /> <br />
