Greg Peterson, Oakwood Land Development, stated that they will construct the trail within their <br />development at their own cost and in addition be charged a trail fee. What is happening in this <br />case is the City is requesting that the trail be extended through the Apple Ridge subdivision in <br />which they will receive credit for. <br /> <br />Councihnember Hendriksen explained that what Councilmember Zimmerman is asking for is <br />that the developer pay for the entire trail because it is the same developer for both subdivisions. <br /> <br />Mr. Peterson replied that he would think that if they are building a trail and paying a fee within <br />their development is fair, but they should receive credit for anything outside their proposed <br />development. <br /> <br />Mayor Gamec inquired if the City would be better off simply collecting the fees and not <br />constructing the trail. <br /> <br />Councill~ember Hendriksen inquired if the trail is not going to connect to anything why should <br />they construct it. <br /> <br />Community Development Director Frolik noted that the Park Commission is looking at a trail <br />corridor along TH #47 to cmmect future developments to the south as well as to Ehncrest Park. <br /> <br />Councilmember Anderson stated that T.H. #47 is not hikeable or walkable without a trail. <br /> <br />Councihnember Zimmerman stated that he felt the issue needed to be discussed further with the <br />developer. <br /> <br />Mayor Gamec replied that it is the City's decision as to whether or not the trail should exist. <br /> <br />City Engineer Olson noted that what was before the Council was preliminary plat approval and it <br />will have to come back for final plat approval. <br /> <br />Councihnember Hendriksen stated that he would like some research to be done to explain why <br />the trail was not constructed as part of Phase I of Apple Ridge. <br /> <br />Mayor Gamec stated that the Council could approve the preliminary plat with the trail and then <br />they could remove it later if appropriate. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Resolution #02-01-020 <br />to approve the preliminary plat for River Pines 5t~' Addition contingent upon compliance with <br />City staff review letter dated December 26, 2001, and including the trail segment along T.H. #47 <br />to the south end of Apple Ridge. <br /> <br />City Council/January 22, 2002 <br /> Page 12 of 25 <br /> <br /> <br />
