Mot/on by Couneilmember Kurak, seconded by Couneilmember Anderson, to adopt Resolution <br />#02-02-039 adopting Findings of Fact # 0599 relating to a request to rezone the proposed plat of <br />The Ponds fi'om B-1 Business and R-1 Single Family Residential to R-1 Single Family <br />Residential, R-3U Residential, and Multiple Residential. <br /> <br />Further discussion: City Attorney Goodrich noted that by adopting the positive findings of facts <br />it would be very difficult for the Council to deny introduction of the rezoning ordinance. <br />Councihnernber Anderson replied that the land use is supposed to follow the land use <br />designations in the Comprehensive Plan, which this request does. City Attorney Goodrich stated <br />that that was correct. Councilmember Hendriksen stated that the proposed rezoning is not <br />consistent with the Comprehensive Plans. <br /> <br />Councilmember Kurak called the question. <br /> <br />Question carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson. Voting <br />No: Councilmembers Hendriksen and Zimmerman. <br /> <br />Motion carried. Voting <br />No: Councihnembers Hendriksen and Zimmerman. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to introduce an <br />ordinance to rezone the proposed plat of The Ponds from B~I Business and R-1 Single Family <br />Residential to R~ 1 Single Family Residential, R-3U Residential, and Multiple Residential. <br /> <br />Motion carried. Voting <br />No: Councilmembers Hendriksen and Zimmerman. <br /> <br />Case #2: Request for Preliminary Plat of The Ponds; Case of Royal Oaks Realty <br /> <br />Principal Planner Trudgeon stated Royal Oaks Realty has resubmitted a preliminary plat showing <br />the development of 86.71 acres at the comer of Dysprosium Street and Nowthen Boulevard. <br />Royal Oaks Realty is proposing to develop 88 single-family lots, 91 townhome units and 82 <br />senior apartment units for a total of 261 housing units on this property. The applicant previously <br />submitted a preliminary plat in Spring 2001, for consideration. The original preliminary plat was <br />proposed as a Planned Unit Development (PUD) which had 73 single family lots, 152 <br />townhome units, and 82 senior apartment units for a total of 307 housing units. Along with the <br />preliminary plat, Royal Oaks Realty has submitted a rezoning request (from B-1 Business and R- <br />1 Single Family to R-1 Single Family Residential, R-3U Residential, and Multiple Residential) <br />and a townhouse site plan review request. The site plan for the apartment building has not <br />changed from the original application. The apartment site plan as well as the height variance <br />appeal needs to be reviewed by the City Council. The property is currently zoned R-1 Single <br />Family and B-1 Business. As mentioned above, the applicant is asking for a rezoning to R-l, R- <br />3U, and MR. The adopted Comprehensive Plan shows approximately 7.52 acres of this property <br />being High Density Residential, 13.52 acres being Medium Density Residential and 65.67 acres <br /> <br />City Council/February 12, 2002 <br /> Page 13 of 33 <br /> <br /> <br />
