PROPOSED FINDINGS OF FACT <br />GLEN & BROCK HAMMERSCHMIDT <br /> <br />That Glen & Brock Hammerschmidt hereinafter referred to as <br />,'Applicants" have properly applied for a vacation of drainage <br />easements on Lots 3 and 4, Block 3, Woodland Green. <br /> <br />The city has given written notice to all residents within 300 <br />feet of the proposed vacation of the easements and also caused the <br />notice to be published in the City's official newspaper. <br /> <br />The City has held a public hearing on the proposed vacation of the <br />easements. <br /> <br />The applicant on Lot 4, Block 3, is proposing to construct a <br />residential structure which would abutt the existing easement. <br /> <br />The proposed construction of the structure on Lot 4 will require <br />four to five feet of fill which is proposed to be sloped <br />approximately 30 feet into the existing easement. <br /> <br />The lot to the east of Lot 4 has an existing structure which has <br />been filled and sloped into the existing drainage easement. <br /> <br />The City Engineer has reviewed the drainage in the area and <br />calculated that the runoff from a 100 year storm would not impact <br />any portion of Lots 3 and 4, Block 3, Woodland Green. <br /> <br />The City has increased the ponding capacity of the adjacent <br />property by excavating a ponding area. <br /> <br />The applicants nor the city have never observed standing water on <br />the applicants property. <br /> <br /> <br />
