Councilmember introduced the following <br />resolution and moved for its adoption: <br /> <br />RESOLUTION 088- <br /> <br /> WHEREAS, Glen and Brock Hammerschmidt are the fee owners of Lots <br />3 & 4, Block 3, Woodland Green; and <br /> <br /> WHEREAS, the city has an easement for drainage purposes over the <br />South 75 feet of said Lot 4 and the South 75 feet of the East 22 feet <br />of said Lot 3; and <br /> <br /> WHEREAS, Mr. Brock Hammerschmidt is proposing to build a house on <br />said Lot 4 which abutts the north line of the 75 feet wide drainage <br />easement; and <br /> <br /> WHEREAS, Mr. Brock Hammerschmidt has requested the City to vacate <br />the north 50 feet of its drainage easmenet on said Lot 4 to allow for <br />sloping the fill to the proposed elevation of the house; and <br /> <br /> WHEREAS, Mr. Glenn Hammerschmidt.has requrested the City to <br />vacate the North 50 feet of its drainage easement on Lot 3 to provide <br />a consistent drainage easement on each lot; and <br /> <br /> WHEREAS, The city Engineer has reviewed the request to vacate the <br />North 50 feet of the Easement and finds that the vacation will not <br />affect the drainage in the area. <br /> <br /> NOW, THEREFORE, be it resolved by the Ramsey City Council as <br />follows: <br /> <br /> 1. That the City hereby vacates the North 50 feet cf drainage <br />easements over Lots 3 & 4, Block 3, Woodland Green. <br /> <br /> 2. That the City shall retain the South 25 feet of the <br />drainage easements over and across Lots 3 & 4, Block 3, Woodland <br />Green. <br /> <br /> 3. That Glen and Brock Hammerschmidt reimburse the City for all <br />expenses involved in the vacation of the drainage easements. <br /> <br /> The motion for the adoption of the foregoing resolution was duly <br />seconded by Council Member and upon vote <br />being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br /> <br />
