Motion was amended to be subject to the City Attorney confirming that right of access has been <br />obtained. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Anderson, <br />Hendriksen, and Zimmerman. Voting No: None. <br /> <br />Motion by Councihnember Hendriksen, seconded by Councilmember Kurak, to adopt Resolution <br />#02-02-071 approving appraisal of damages for the acquisition of the parcels owned by the <br />MPCA necessary for the construction of the extension of Sunwood Drive and Azurite Streets. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Hendriksen, Kurak, <br />Anderson, and Zimmennan. Voting No: None. <br /> <br />Case #9: Consider Introduction of a No Trespassing Ordinance <br /> <br />City Attorney Goodrich stated that last summer, the Ramsey Police Department ticketed four <br />juveniles, who were sitting on the landfill watching fireworks. The Anoka County Attorney's <br />office refused to proceed with prosecution because state statutes do not prohibit such conduct. <br />Simply walking on a property that has a "no trespassing" sign or a fenced in area is not an <br />offense under state statute. If a person is asked to leave and refuses to leave, or is asked to leave <br />and then returns, then the person can be cited for trespassing under state statutes. The County <br />Attorney's office suggested that the City adopt a no trespassing ordinance similar to the Coon <br />Rapids no trespassing ordinance, in order to prosecute for such violations. Staff recommended <br />that the Council consider a no trespassing ordinance in the interest of cooperating with the <br />MPCA in its management of the closed Anoka Regional Landfill. On August 14, 2001, the City <br />Council directed staff to draft the no trespassing ordinance and to present it for introduction. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to introduce an <br />ordinance adding Section 5.16 to the City Code and which Section provides for prosecution and <br />penalties for persons trespassing certain properties within the City. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Case #10: Introduce Ordinance Vacating Certain City Streets <br /> <br />City Engineer Jankowski stated that a review of the City street system resulted in the <br />identification of three dedicated segments of right-of-way, which appeared to have no reasonable <br />public purpose for roadway. Two of the segments were undeveloped as roadway. The third <br />pm'cel, a segment of Juniper Ridge Drive is presently paved. It was proposed that the existing <br />pavement would be removed and restored by placing topsoil, seed and mulch. A public hearing <br />was held on the proposed vacations on October 23, 2001 and no comments were offered. <br /> <br />City Council/February 26, 2002 <br /> Page 29 of 35 <br /> <br /> <br />
