Motion was amended to be subject to the City Attorney confirming that right of access has been obtained. Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Anderson, Hendriksen, and Zimmerman. Voting No: None. Motion by Councihnember Hendriksen, seconded by Councilmember Kurak, to adopt Resolution #02-02-071 approving appraisal of damages for the acquisition of the parcels owned by the MPCA necessary for the construction of the extension of Sunwood Drive and Azurite Streets. Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Hendriksen, Kurak, Anderson, and Zimmennan. Voting No: None. Case #9: Consider Introduction of a No Trespassing Ordinance City Attorney Goodrich stated that last summer, the Ramsey Police Department ticketed four juveniles, who were sitting on the landfill watching fireworks. The Anoka County Attorney's office refused to proceed with prosecution because state statutes do not prohibit such conduct. Simply walking on a property that has a "no trespassing" sign or a fenced in area is not an offense under state statute. If a person is asked to leave and refuses to leave, or is asked to leave and then returns, then the person can be cited for trespassing under state statutes. The County Attorney's office suggested that the City adopt a no trespassing ordinance similar to the Coon Rapids no trespassing ordinance, in order to prosecute for such violations. Staff recommended that the Council consider a no trespassing ordinance in the interest of cooperating with the MPCA in its management of the closed Anoka Regional Landfill. On August 14, 2001, the City Council directed staff to draft the no trespassing ordinance and to present it for introduction. Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to introduce an ordinance adding Section 5.16 to the City Code and which Section provides for prosecution and penalties for persons trespassing certain properties within the City. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, and Zimmerman. Voting No: None. Case #10: Introduce Ordinance Vacating Certain City Streets City Engineer Jankowski stated that a review of the City street system resulted in the identification of three dedicated segments of right-of-way, which appeared to have no reasonable public purpose for roadway. Two of the segments were undeveloped as roadway. The third pm'cel, a segment of Juniper Ridge Drive is presently paved. It was proposed that the existing pavement would be removed and restored by placing topsoil, seed and mulch. A public hearing was held on the proposed vacations on October 23, 2001 and no comments were offered. City Council/February 26, 2002 Page 29 of 35
