perfermed by him in the enforcement of any provisions of this ordinance shall be <br />defended by the legal department of the City of Ramsey until final termination <br />of the proceedings. <br /> <br /> 9.03 Cooperation cf Other Officials. The plumbing inspector authority may <br />request, and shall receive so far as may Re necessary in the discharge of his duties, <br />the assistance and cooperation cf the other officials of the City of Ramsey. <br /> <br />10. APPEALS. <br /> <br /> Appeals from the plumbing inspector's decision and requests for variances as to <br />any provisions of this ordinance may be made to the Ramsey City Council. The City <br />Council may grant a variance to the strict terms or requirements of this ordinance <br />as it affects specific tracts of land if it finds: <br /> <br /> 1. It is shown by reason of topography or other physical conditions <br />that strict compliance with the ordinance's requirements could cause an <br />exceptional and undue hardship to the enjoyment of a substantial property right. <br /> <br /> 2. By the granting of the variance, the spirit and intent of the ordinance <br />will not be adversely affected. <br /> <br /> 3. That the variance will not be injurious to the health and/or general <br />welfare of (a) the users of the system for which the variance is sought (b) The <br />adjacent property owners and (c) the general community as a whole. <br /> <br /> 4. That the establishment, maintenance or operation of the system as permitted <br />by the variance will not be detrimental to or endanger the public health, safety or <br />general welfare and is not contrary to established standards, regulations or ordinances <br />of other governmental agencies. <br /> <br />11. REPEAL. <br /> <br /> Any provisions of any existing ordinances which are in conflict herewith <br />are hereby repealed. <br /> <br />12. VIOLATIONS AND PENALTIES. <br /> <br /> It shal'l be unlawful for any person, firm, or corporation to erect, construct, <br />enlarge, alter, repair, move, improve, remove, convert, use, occupy, or maintain any <br />sewage disposal system in the City of Ramsey or cause the same to be done, contrary <br />to or in violation of any of the provisions of this ordinance. <br /> <br />31 <br /> <br /> <br />
