At the time of service of notice as above described, the plumbing inspector <br />shall also by mail forward a copy of sa~d notice to the Minnesota Health Department <br />and the Minnesota Pollution Control Agency. <br /> <br /> 8.03 Criteria for Health Hazard. Criteria for determination that a system <br />is a health hazard shall include but not be limited to the following: <br /> <br /> a. The appearance of on-site disposal system effluent into surface waters <br />at any time, or on the ground surface continuously or intermittently over a period <br />of fifteen (15) consecutive days. <br /> <br /> b. The exposure for more than seventy-two (72) hours of an on-site system <br />or part thereof that is in use. <br /> <br /> c. A system in which the level of effluent is sufficiently close to the <br />ground surface to result in offensive odors. <br /> <br /> 8.04 Right to Repair. In case the owner shall fail, neglect or refuse to <br />comply with the notice to repair or rehabilitate or abate as described in Section <br />8.02 above the City Council may order the owner of the building prosecuted as a <br />violator of the provisions of this ordinance and may order the plumbing inspector <br />to proceed with the work specified in such notice. A statement of the cost of such <br />work shall be transmitted to the City Council, who shall cause the same to be paid <br />and levied as a special assessment against the property. <br /> <br /> 8.05 Costs. Costs incurred under Section 9.04 shall be paid out of the City's <br />general fund. Such costs shall be charged to the owner of the premises involved <br />as special assessment on the land on which the building or structure is located, <br />and shall be collected in the manner provided for special assessments. <br /> <br />9.0 ADMINISTRATION. <br /> <br />9.01 The plumbing inspector shall enforce the provisions of this ordinance. <br /> <br /> 9.02 Liability. The plumbing inspector or any employee charged with the <br />enforcement of this ordinance, acting in good faith and without malice for the <br />City in the discharge of his duties, shall not thereby render himself liable <br />personally and he is hereby relieved from all personal liability for any damage <br />that may accrue to persons or property as a result of any act required or by <br />reason of any act or omission in the discharge of his duties.
