3. In the event the plan as submitted for final <br />approval is not in substantial compliance with the <br />preliminary plan, the City Council shall notify the <br />applicant within forty-five (45) days of tt~e date of <br />application setting forth the ways in which the plan <br />is not in substantial compliance. <br /> <br />a. The applicant may treat such notification as <br />denial of final approval; or <br /> <br />b. The applicant may refile his plan so that it <br />does substantially comply with the preliminary plan; <br />or <br /> <br />c. The applicant may file a written request with <br />the City Council that it hold a public hearing on <br />his request for final approval. Any such hearing <br />shall be held within thirty (30) days after the <br />request for such a hearing. Within forty-five (4S) <br />days of such hearing the City Council shall eithe <br />grant final approval or deny final approval to <br />plan. <br /> <br />4. In_the event a plan is given final approval and <br />the applicant shall abandon said plan or in the event <br />the applicant shall fail to begin construction of the <br />planned unit development within twelve (12) months <br />after the final approval has been granted, final <br />approval shall terminate unless such time period is <br />extended by the City Council. <br /> <br />(C) General Requirements: In a planned unit development <br />the following regulations should be considered prior to <br />the submission of a preliminary development plan. <br /> <br />1. Ownership: The tract of land shall be under <br />u~ified control at the time of application and <br />duled to be developed as one unit. <br /> <br />2. Minimum Size: No planned unit development may <br />include less than five (5) acres of contiguous land. <br /> <br />3. Minimum Building Spacing: Any buildings exceeding <br />the height limits permitted in the surrounding districts <br />shall be so located as to eliminate the possibility of <br />unbroken shadows on adjoining parcels. <br /> <br />4. Harmony: The planned unit development should be <br />planned and developed to harmonize with both existing <br />and proposed developments in the area surrounding the <br />project. <br /> <br />5. Permitted Uses: The permitted uses may include: <br /> <br />a. Any combination of dwelling units in single <br />family, two family, town or ro~ houses and apart- <br />ments. <br /> <br />-14- <br /> <br /> <br />
