S.8 <br /> <br />(A) The Planning Commission shall conduct a public <br />hearing on the Urban Development permit application and <br />-shall give at least ten (10) days mailed notice to <br />property owners within 3S0 feet of the outer boundaries <br />of the property in question. Ten (10) days published <br />notice shall also precede the hearing. Any person may <br />appear and testify at the hearing either in person or <br />by duly authorized agent. The Planning Commission shall <br />forward its findings on the application to the City <br /> Council within thirty (30) days of the public hearing, <br /> unless the applicant agrees in writing to a time extension. <br /> <br />(B) The City Council shall review the application, zoning <br />officer's findings and findings of the Planning Commission <br />and~shall act on said application within thirty (30) days <br />after receipt from the Planning Commission. If the City <br />Council denies the application, that action shall be the <br />City's final administrative act on the application. <br /> <br />(C) If the City Council approves the application, as a <br />condition of that approval, the Council may attach such <br />conditions as it deems necessary. Ail development, <br />construction and use shall be in accordance with the <br />approved site plan and conditions required by the City <br />Council. Any development not in accord with the approved <br />plan shall constitute a violation of this Ordinance. <br /> <br />(D) In approving or disapproving the application, the <br />City Council shall adopt written findings detailing the <br />reasons for its action. <br /> <br />EXEMPTION: The use of one parcel for one single family <br />dwelling to be located on a lot of one acre or less in size <br />in a UR OS UER District'shall'be exempt .from Sections 5.2, 5.3, <br />5.4, 5.5, 5.'6 and 5.7. <br /> <br />-20- <br /> <br /> <br />
