6.3 <br /> <br />(B) Ten (10) copies of a site plan and supporting data which <br />shows the size, location and. topography of the site, the use <br />of adjacent land, the proposed site, bulk, use and location <br />of buildings; the location and proposed function of all yards, <br />open sp~ces, parking areas, driveways, storage areas and <br />accessory structures; the location of all utilities, the pro~ <br />visions for parking, moving or loading of vehicles and the <br />timing of construction proposed. <br /> <br />REVIEW AND TERM: The zoning officer shall forward copies of the <br />application to the City Council and to the Planning Commission for <br />review and approval. <br /> <br />(A) The P%anning Commission shall conduct a public hearing on <br />the conditional use application and shall give at least ten (10) <br />days mailed notice to property owners within 350 feet of the <br />outer boundaries of the property in question. Ten (10) days <br />published notice shall precede the hearing. Any person may appear <br />and testify at the hearing either in person or by duly authorized <br />agent. The Planning Commission shall forward its findings on <br />tho application to the City Council within thirty (30) days of <br />the public hearing unless the petitioner agrees in writing to a <br />time-extension. <br /> <br /> (B) The City Council shall review the application and findings <br />of the Planning Commission and shall act on said application <br />within thirty (30) days after receipt from the Planning Commission. <br />If the City Council denies the..apptication, that action shall be <br />the City's final administrative action on the application. <br /> <br />(C) If the City Council approves the application, as a condition <br />of that approval, the Council may attach such conditions as it <br />deems necessary. Ail development, construction and use shall be <br />in accordance with the approved plan and conditions required by <br />the City Council. Any development not in accord with the approved <br />plan and conditions shall constitute a violation of this Ordinanl <br />The conditions imposed shall be imposed only in order to protect <br />the public health, safety, convenience and welfare or to avoid <br />traffic congestion or hazard, or'other dangers, or to promote <br />conformity of a proposed use with the character of the adjoining <br />property and uses, and the district as a whole, or to protect <br />such character. <br /> <br />(D) The term of a conditional use permit issued herein shall be <br />indefinite and may be revoked only upon an affirmative showing <br />that the site is not being used for the use originally authorized <br />in the conditional use permit issued and in accord with the con- <br />ditions attached by the City Council. <br /> <br />(E) In approving or disapproving 'the application, the City Council <br />shall adopt written findings detailing the reasons for its action. <br /> <br />-36- <br /> <br /> <br />
