SECTION 7 TEMPORARY CONDITIONAL 'USE PEPuX{ITS <br /> <br />7.1 <br /> <br />7.2 <br /> <br />7.3 <br /> <br />PURPOSE: Certain uses that are generally not suitable within a <br />particular zoning district are potentially suitable on a temporary <br />basis. This may be due to the lack of development on existing <br />property, to a short-term need (such as highway construction), or <br />to the limited degree of adverse effects upon adjacent land use. <br /> <br />Although such uses may not be consonant with tile uses authorized <br />by this Ordinance for a particular district, the state of develop- <br />ment may make it advantageous to allow certain Temporary Uses, by <br />conditional permit in accordance with the following: <br /> <br />CRITERIA: Application fora temporary conditional use permit shall <br />be made to the zoning officer and no temporary conditional use <br />permit shall be granted for a temporary use, unless the.zoning officer <br />shall find that: <br /> <br />Adjacent vacant land is not yet ready for development <br />6r will not be affected by the proposed use. <br /> <br />Adjacent developed land will not be adversely affected <br />by the proposed use because of traffic, noise, dust, <br />smoke, unsightliness. <br /> <br /> c. The period of time for which the Temporary Conditional <br /> Use Permit is to be granted will terminate before any <br /> adverse effects are felt upon adjacent property. <br /> <br /> d. There is adequate assurance, guaranteed by perfOrmance <br /> bond, if necessary, that the-property will be left in <br /> suitable condition after the use is terminated. <br /> <br />USES WHICH MAY BE GIVEN A TEMPORARY CONDITIONAL USE PERMIT: If <br />the above conditions are met, Temporary conditional Use Permits for <br />specified limited periods of time may be issued for the following: <br /> <br />a. Blacktop or crushing plant for highway materials. <br /> <br />Carnivals or circus for period not to exceed twenty-one <br />(21) days. <br /> <br />c. Christmas tree sales. <br /> <br />d. Excavating business - sand, gravel or black dirt. <br /> <br />e. Stockpiling of materials for use in highway construction. <br /> <br />Religious meeting or tent or other temporary structure <br />for a period not to exceed sixty (60) days. <br /> <br />-39- <br /> <br /> <br />
