7.4 <br /> <br />ISSUANCE' The temporary conditional use permit may be issued <br />by the zoning officer, subject to approval by the City Council. <br /> <br />8.1 <br /> <br />8.2 <br /> <br />g.3 <br /> <br />8.4 <br /> <br />SECTION 8 - BOARD OF ADJUST~,IENT AND VARIANCES <br /> <br />BOARD OF ADJUST~[ENT: In accordance with Minnesota Statutes <br />462.351 to 462.364, a Board of Adjustment shall be appointed by <br />the City Council. The Board of Adjustment shall elect a chairman <br />and vice-chairman and appoint a secretary. It shall hold <br />meetings, keep minutes and pursuant to notice, shall conduct <br />hearings, take testimony under oath and render decisions in <br />writing within forty-five (45) days after the hearing or <br />continued hearing. A fee shall be charged in accordance ~¢ith <br />a schedule annually affixed by resolution for any appeal or <br />proceedin~g filed with the Board of Adjustment. <br /> <br />APPEALS: The Board of Adjustment shall have the power to hear <br />and decide appeals from any order, requirement, decision, grant <br />or refusal made by the zoning officer in the administration of <br />this Ordinance. An appeal shall be in writing and filed in <br />duplicate with the zoning officer. Within ten (10) days after. <br />filing of the appeal, the zoning officer shall transmit to the <br />Board of Adjustment all papers involved in the proceedings. <br />Upon receipt of this material the Board of Adjustment shall set <br />a hearing date and give notice by mail of the time, place and <br />purpose thereof to the appellant and to the zoning officer. <br />The Board of Adjustment may reverse or affirm wholly or in part <br />any ruling decision or determination of the zoning officer and <br />may issue or direct the issuance of a permit. The decision of <br />the' Board of Adjustment may ~e appealed to the City Council if <br />the City Council is not the Board of Adjustment and its decision <br />may be appealed to the District Court.: <br /> <br />VARIANCES PURPOSE: The purpose of this section is to provide the <br />City of Ramsey with an opportunity for amelioration of · . <br />unnecessary hardships resulting from the rigid enforcement of <br />its broad zoning ordinance. This variance provision authorize <br />the Board of Adjustment to permit a particular property to be <br />used in a manner forbidden by the ordinance by varying the <br />terms Of the ordinance. <br /> <br />VARIANCE LIblITATION: The Board of Adjustment, upon appeal, shall <br />have the pox~er to authorize variances from certain requirements <br />of this ordinance. Variances shall pertain only to the physical <br />characteristics of the land or structures to be built thereon, <br />such as area, height, extent of lot cove?age, setback require- <br />ments, density and parking requirements. Specifically, the <br />Board of Adjustment may grant only non-use or area variances <br />and may not grant use variances such as permitting a retail <br />business--frS- be located in a residential district. <br /> <br />-40 - <br /> <br /> <br />
