9.2 <br /> <br />Within a reasonable time after the hearing, the Board of Adjust- <br />ment shall make its order deciding the.~matter and serve a copy <br />of such'order upon the appellant or the'petitioner by mail. If <br />the City Council does not act as the Board of Adjustment, the <br />Board of Adjustment's decision may be appealed to the City Council. <br />The City Council after review of the Board of Adjustment's minutes, <br />records and file, may affirm, reverse or modify the Board of <br />Adjustment's action. If the City Council acts as the Board of <br />Adjustment or after the City Council acts on a Board of Adjust- <br />ment's decision, this shall be the final action of the City on <br />the variance application. <br /> <br />SECTION 9. - AMENDMENTS <br /> <br />AMENDMENTS: The City Council may amend this Ordinance as proposed <br />by a member of the City Council, by the Planning Commission or by <br />a petition of a person residing or owning'property within the City <br />of Ramsey in accordance with the following provisions: <br /> <br />PROCEDURE: <br /> <br />Petitions for amendment shall be filed with the Planning <br />Commission, and the petitioner, upon such filing, shall <br />pay an advertising deposit and a filing fee in accordance <br />with a schedule annually affixed by resolution. The <br />Planning Commission shall review the proposed amendment <br />and report its findings and recommendations in writing to <br />the City Council and to the petitioner. The proposed <br />amendment shall be introduced~.ibefore the City Council only <br />if a member of the City~.Council elects to do so. If an <br />amendment proposed by petition is not introduced, the <br />advertising deposit shall be refunded to the petitioner; <br />otherwise such deposit shall be paid to the City. <br /> <br />Any proposed amendment introduced by a member of the City <br />Council without written findings and recommendations from <br />the Planning Commission shall be referred to the Planning <br />Commission for revie~ at least thirty (30) days prior to <br />public hearing by the Council. The City Council may not <br />act upon the proposed amendment until sixty (60) days <br />have elapsed from the date of reference of'the amendment <br />without a report from the Planning Commission. <br /> <br />Before voting on the enactment of an amendment, the City <br />Council shall hold a public hearing thereon pursuant to <br />public notice. It shall be the responsibility of the <br />zoning officer to have notice of the time, place and <br />purpose of the public hearing published in the official <br />city newspaper ten (10) days prior to the hearing. <br /> <br />Also, when an amendment involves changes in district <br />boundaries affecting an area of five acres or less, a <br />written notice of the hearing stating its time, place and <br />purpose shall be mailed by the zoning officer at least <br />ten (10) days before the day of the hearing to each <br /> <br /> <br />
