10.1 <br /> <br />10.2 <br /> <br />owner of affected property and property situated <br />wholly or partly within 350 feet of the property to <br />~ihich the amendment relates. For the purpose of <br />g].ving mailed notice, the zoning officer may use any <br />appropriate records to determine the names and addresses <br />of owners. A copy of the notice and a list of the <br />owners and addresses to which the notice was sent shall <br />be attested to by the zoning officer and shall be made <br />a part of the records of the proceedings. The failure <br />to give mailed notice to individual property owners, or <br />defects in the notice shall not invalidate the proceedings, <br />provided.a bona fide attempt to comply with this section <br />has been made. <br /> <br />r4. <br /> <br />If, after any public hearing held upon an amendment, the <br />proposed amendment is revised or further revised to include <br />land previously not affected by it, the City Council shall <br />hold another public hearing, pursuant to public notice, <br />before proceeding to vote on the amendment. <br /> <br />The City Council shall act upon the request within forty <br />five (45) days after the last public hearing has been held. <br /> <br />A four-fifths (4/5) affirmative vote of the City Council <br />shall be required for passage of any amendment to this <br />Ordinance. <br /> <br />SECTION 10 ADMINISTRATION AND ENFORCE~,IENT <br /> <br />ZONING OFFICER: The zoning officer, Who shall be appointed hy the <br />City Council, shall: - <br /> <br /> (A) Administer and enforce the provisions of this Ordinance <br /> in accordance with its literal terms and shall not have the <br /> power to permit any construction or any use or change of use <br /> which does not conform to this Ordinance. <br /> <br /> (B) Issue Zoning certificates, building permits and temporary <br /> conditional use permits. <br /> <br />(C) Maintain a permanent file of all zoning certificates and <br />applications as public records. <br /> <br />ZONING CERTIFICATES: A zoning certificate or Urban Development <br />Permit if subject property is in a "U" district shall be obtained <br />before any person may: <br /> <br /> (A) Occupy or use any vacant land; or <br /> <br />(B) Occupy or use any structure hereafter constructed, <br />reconstructed, moved, altered or enlarged; or <br /> <br />(C) Change the use of a structure or land to a different use; or <br /> <br />(D) Change a non-conforming use. <br /> <br />-43- <br /> <br /> <br />
