into a development agreement based on that plan, then the property is rezoned when the plan <br />moves forward. <br /> <br />City Attorney Goodrich noted that in the event the resolution is not adopted, the Council should <br />state the reasons for their vote. <br /> <br />Motion by Councihnember Hendriksen, seconded by Councilmember Zimmerman, to adopt a <br />Findings of Fact to deny an amendment to the Comprehensive Plan. <br /> <br />Further discussion: Mayor Gamec inquired as to what the current zoning was. Principal Planner <br />Trudgeon replied industrial. Councilmember Anderson noted that the newly adopted <br />Comprehensive Plan has the land use as residential. She noted that finding #6 states that the <br />Planning Commission recommended approval of the request, which does not support denial. <br />City Attorney Goodrich replied that the Planning Commission recommendation is a fact they <br />cannot deny and noted that not every finding has to be towards the goal they are trying to <br />accomplish. Councilmember Anderson inquired if they were only voting for the findings of fact <br />at this point. City Attorney Goodrich replied yes, noting that the findings would include the <br />additional finding as requested by Councilmember Hendriksen. Councilmember Zimmerman <br />inquired if they should include that the Comprehensive Plan was just adopted in December 2001. <br />City Attorney Goodrich noted that that was already included in the findings. <br /> <br />Motion failed. Voting Yes: Councilmembers Hendriksen, and Zimmerman. Voting No: Mayor <br />Gamec, and Councilmember Anderson. Abstained: Councilmember Kurak. <br /> <br />Mayor Gamec stated that he agreed with Planning Commission recommendation and noted that <br />in most cases the City has not required a concept plan for a comprehensive plan amendment. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to adopt the <br />resolution denying an amendment to the Comprehensive Plan. <br /> <br />Further discussion: Councilmember Hendriksen stated that he agreed with the findings of fact <br />the Council had just voted on and it was based on those findings of fact that he made his motion. <br /> <br />Motion failed.
