Mayor Gamec stated that he felt that a mixed use land designation would allow the City to have <br />an alternative plan for the land rather than simply saying the land should be either residential or <br />industrial. <br /> <br />Councihnember Zilmnerman stated that with the heavy shopping areas in Andover and Elk <br />River, he felt it was unrealistic to think that Ramsey could get shopping on the property, and it <br />would more likely be townhomes or apartments. <br /> <br />Counci hnember Hendriksen stated that absent any documents, how can they know what will end <br />up on the site. He stated that the City has a written policy that requires a concept plan be <br />submitted for a Comprehensive Plan amendment and he opposes ignoring that policy. Absent <br />the appropriate documentation he did not know how they could proceed. He stated that there <br />was nothing that would preclude the applicant from following the policy and brining it back for a <br />more favorable ruling. <br /> <br />City Attorney Goodrich stated that it appeared that the motion to approve did not pass because <br />the Council failed to receive the proper votes and the motion to deny did not pass because the <br />Council failed to receive the proper votes, therefore, the application was denied. He requested <br />that the Council declare that the application is not granted because no further action could be <br />taken therefore the action failed. <br /> <br />Mayor Gamec agreed that the Council could not take any further action. <br /> <br />City Attorney Goodrich stated that the Council had complied with the responsibilities set forth in <br />the State's 60-day rule. <br /> <br />City Attorney Goodrich stated that the City received a letter dated March 8, 2002, requesting that <br />the Council table action on the Kurak property along Sunwood Drive and waiving the 60-day <br />rule. Mr. Goodrich did verify with the applicant that he indeed sent the letter. <br /> <br />Councilmember Hendriksen noted that Mr. Kurak was not waiving the 60-day rule, but <br />extending it to a date certain. <br /> <br />City Attorney Goodrich replied that was correct, noting that the date was extended to May 1, <br />2002. <br /> <br />Mr. Ragor stated that he was pleased that Mr. Kurak is willing to meet with the neighbors in <br />regards to the matter. He inquired if there was an official committee being put together to meet <br />with Mr. Kurak. <br /> <br />Mayor Gamec stated that at the last Council meeting he had requested that a couple of the <br />residents from the area meet with Mr. Kurak as representatives of the neighborhood, but one of <br />the residents declined because she felt that more people should be involved and Mr. Kurak <br /> <br />City Council/March 12, 2002 <br /> Page 14 of 23 <br /> <br /> <br />
