The development is creating the problem and the developer should be part of <br />the solution. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#02-03-076 to approve the final plat for River Pines 5th Addition contingent upon compliance <br />with the City staff review letter dated March 7, 2002, the completion of a sound study for sound <br />mitigation and the developer entering into a development agreement with the City. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson. Voting <br />No: Councihnembers Hendriksen, and Zimmerman. <br /> <br />Councihnember Zimmennan stated that he was opposed because the development was creating a <br />dangerous intersection and they should, as a City, do something about rather than wait. <br /> <br />Case #3: Consider Adoption of No Trespassing Ordinance <br /> <br />City Administrator Norman stated that on August 14, 2001, the City Council directed staff to <br />draft a no trespassing ordinance to be presented for introduction. That ordinance was presented <br />for Council review and introduction on February 12, 2002. At that time it was tabled and re- <br />presented to Council on February 26, 2002. The Council introduced the ordinance and directed <br />staff to bring it back for forrnal adoption. <br /> <br />Motion by Councihnember Anderson, seconded by Councilmember Kurak, to adopt Ordinance <br />#02-08 adding Section 5.16 to the City Code, which provides for prosecution and penalties for <br />persons trespassing on certain properties within the City. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councihnember Zimmerman aye <br />Councilmember Hendriksen aye <br />Councilmember Anderson aye <br />Councilmember Kurak aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #4: Adopt Ordinance Vacating Certain City Streets <br /> <br />City Engineer Jankowski stated that a review of the City street system resulted in the <br />identification of three dedicated segments of right of way, which appeared to have no reasonable <br />public purpose for roadway. Two of the segments are presently undeveloped as roadway. The <br />third parcel, a segment of Juniper Ridge Drive, was presently paved. It was proposed that the <br />existing pavement would be removed and restored by placing topsoil, seed and mulch.
