for the existing homestead to 158tl~ Court. MnDOT also suggested consideration of a northbound <br />bypass lane at 157th. As a result of subsequent conversations between MnDOT and the City <br />Engineer, it was agreed that construction of a bypass lane cannot be a contingency of the <br />development as River Pines 5t~' is not the only factor creating a need for the bypass lane. <br />Additionally, the cost to construct the bypass lane is not proportionate to the benefit River Pines <br />5th would receive. All of the lots meet or exceed the minimum area and width requirements. <br />Sidewalks will be required along 158th and Lithium Streets. Park dedication will consist of a <br />cash payment. The developer is being required to construct a trail parallel to T.H. #47 from the <br />north boundary of the plat to the south boundary of Apple Ridge. The cost of trail construction <br />outside the boundaries of the River Pines 5th plat will be credited towards the standard trail <br />development fees due on the plat. The final grading plan had been submitted and some minor <br />modifications were suggested. No construction will be allowed until the developer has acquired <br />the necessary permit fi'om the Lower Rum River Water Management Organization. The <br />proposed final plat substantially conforms to the approved preliminary plat. <br /> <br />Councilmember Hendriksen stated that the existing structures appeared to be in the right of way <br />and inquired if that had been addressed. <br /> <br />Principal Planner Trudgeon replied that those will be torn down. <br /> <br />Councihnember Zimmerman stated that the City has received many comments that the turn into <br />the development is unsafe and he felt that it would be worth while to install the right turn lane at <br />this time. <br /> <br />City Engineer Olson stated that staff and MnDOT agreed that they did not feel that they could <br />ask the developer to pay for the entire upgrade to accommodate the 180 trips that would be <br />generated fi'om the proposed plat when there will be 111 additional lots from Apple Ridge using <br />the access. <br /> <br />Councihnember Zilnmerman stated that it has been one developer that has developed the entire <br />area and he felt it was something they should be considering. <br /> <br />City Engineer Olson inquired if the City would be willing to fund a portion of the project. <br /> <br />Councilmember Zimmerman replied that he felt that the developer should pay for the majority of <br />the cost. <br /> <br />City Engineer Oison stated that the issue before the Council only pertains to the 5th Addition, not <br />the entire development, so he did not think legally the City could ask the developer to fund the <br />reconstruction. <br /> <br />Councilmember Zimmerman stated that the County is requiring that right turn lanes be <br />constructed whether it is a private or public development, so he did not think that the City should <br /> <br />City Council/March 12, 2002 <br /> Page 8 of 23 <br /> <br /> <br />
