firm, Computer Numerically Control Milling and Lathing, performs specialized work for
customers in the defense, medical and machine manufacturing trades. The proposed
manufacturing activities are not considered a permitted use in the B-3 Highway Business
District. The proposed manufacturing operations would consist of manufacturing small products,
generally not exceeding 4 inches in size. The applicant is not proposing any outside storage and
truck traffic will consist of small delivery and UPS trucks. It was noted that the Minnesota
Department of Transportation has initiated a TH 10 Interregional Corridor Management Plan for
State Highway #10. The City Council adopted a resolution on January 8, 2002, stating the City's
support for the TH 10 Interregional Con'idor Management Plan to convert TH 10 to a freeway
system. An exact alignment has not been determined, however, MnDOT has stated initial
support for a freeway alignment that is located adjacent to the BNSF railroad tracks. The subject
property could be affected by the future conversion of State Highway #10 to a freeway. Staff is
unable to determine how the subject property will be affected at this time due to the uncertainty
of the exact alignment of the freeway and the timeline for the State Highway #10 project. Staff
does not feel that the condition of the customer/employee parking area and other traveled
portions of the site are in compliance with City Code. The pavement is in a significantly
deteriorated condition. Staff is recommending that the Permittee or his designee install 1 ½ inch
bituminous overlay on the existing customer/employee parking lot. The Planning Commission
recommended approval contingent upon the traveled areas of the site being upgraded with an
overlay of pavement.

Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to adopt
Resolution #02-03-083 adopting Findings of Fact # 0604A relating to the request for a
conditional use permit.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman,
Anderson, and Kurak. Voting No: None.

Councilmember Hendriksen inquired if they were waiving the curbing requirement when the
overlay is completed.

Community Development Director Frolik explained that the curbing could adversely impact the
drainage, which is why it was being waived.

Councihnember Kurak inquired as to what the land use for the property was in the December
2001 Comprehensive Plan.

Community Development Director Frolik replied that the land use is places to shop.

The Council discussed the leasing of the property.

Councihnember Kurak inquired if the lease was already entered into or was it contingent on
receiving the conditional use permit.

City Council/March 26, 2002
