Mayor Gamec:
Councihnember Cook:
Councihnember Elvig:
Councihnember Kurak:
Councilmember Pearson:
Councihnember Strommen:
Councilmember Zimmerman:

aye
aye
aye
aye
aye
aye
aye

Motion carried.

Case #4:

Request for an Amended Conditional Use Permit to Construct a Building
Larger than 35,000 Square Feet in the TC-2 Zoning District, Case of
Ramdanee, LLC

Community Development Director Frolik explained this conditional use permit relates to the
Coborn's grocery store in Ramsey Town Center 3rd Addition. The City Council granted final site
plan approval of the Coborn's store under the current conditional use permit allows a building
size of 63,000 square feet. The applicants have indicated the potential for the Coborn's store to
expand to 70,000 square feet in the future. Increasing the ultimate size of the building from
63,000 square feet to 70,000 square feet requires an amendment to the conditional use permit
issued in July. The Planning Commission and staff recommend approval of the amended
conditional use permit to allow for a building larger then 35,000 square feet in the TC-2 Zoning
District.

Councilmember Kurak asked how the larger building affects the parking requirements.

Community Development Director Frolik replied the applicant still meets the parking
requirements. The reason they are making this building bigger is to take the liquor store and put
it in the Cobom's facility.

Councihnember Elvig commented a liquor license would be needed to have the liquor store
inside o£ Coborn's. He questioned if they are putting the cart before the horse.

Community Development Director Frolik replied the applicant's intent is to put the liquor store
there; it is not an obligation if they do not get the liquor license. This amendment just sets the
cap on the size of the building.

Councihnember Elvig stated he would recommend the applicant come forward and find out if a
liquor license will be approved for that structure before they build that site.

Motion by Councilmember Cook, seconded by Councilmember Kurak, to adopt Resolution #04-
11-355 adopting Findings of Fact #0709 relating to Ramdance LLC's request for an amended
Conditional Use Permit to construct a building larger than 35,000 square feet in the TC-2 Zoning
District.

City Council/November 23, 2004
