Authority <br /> <br />473.869 EXTENSION. A local governmental unit may by resolu- <br />tion request that the Council extend the time for fulfilling <br />the requirements of Laws 1976, Chapter 127, Sections 1 to 23. <br />A request for extension shall be accompanied by a description <br />of the activities previously undertaken by a local govern- <br />mental unit in fulfillment of the requirements of Laws 1976, <br />Chapter 127, Sections 1 to 23, and an explanation of the rea- <br />sons necessitating and justifying the request. Upon a finding <br />of exceptional circumstances or undue hardship, the Council <br />may, in its discretion, grant by resolution a request for <br />extension and may attach reasonable requirements or conditions <br />to the extensions. <br /> (1976 c 127 s 20) <br /> <br />Statement o~f Intent and General Requirements <br /> <br />It is the intent of the Council to promote the adoption of <br />high quality, local comprehensive plans that complement <br />regional plans. <br /> <br />Requests for extending the time period established by the MLPA <br />for preparing local plans will be considered by the Council on <br />a case-by-case basis. Extensions will be granted according to <br />the provisions of MSA 473.869 based on the facts and merits of <br />the request. An effort will be made to limit the length of <br />extensions to the most practicable minimum time necessary to <br />complete remaining work program items. Only one extension may <br />be granted to each local government. The following approach <br />will be followed: <br /> <br />a) <br /> <br />In those cases where the Council has clearly caused a <br />delay in local plan completion because essential infor- <br />mation was not provided in a timely manner, the local <br />planning period will be extended. <br /> <br />b) <br /> <br />In other cases, the burden of showing exceptional circum- <br />stances or undue hardship will rest with the local govern- <br />mental unit. A major consideration will be whether the <br />reasons are within the local government's control. <br /> <br />3D Requests for extensions must incude the following information: <br /> <br />a) A resolution of the government body stating the request; <br /> <br />b) <br /> <br />A description of the planning activities previously under- <br />taken and accomplished; <br /> <br />c) <br /> <br />An explanation of the reasons why an extension is neces- <br />sary; and <br /> <br />d) <br /> <br />A revised schedule for plan adoption which the local gov- <br />ernment will follow to comply with the MLPA. <br /> <br />The LUAC will be notified of all extension requests submitted <br />to the Council. <br /> <br /> <br />
