E. Enter into a development agreement with the City. On December 7, 1988, the City received a ·response from the Minnesota Environmental Quality Board regarding the trail that would traverse Bulow's Addition along a 20 foot wide corridor adjoining the South side of Front Street. EQB recommends that Bulow's Addition and Riverview Estates Plats be denied. Also thal the City is advised to resubmit the plat incorporating a minimum 30 foot river trail corridor as recommended by Metropolitan Council and Anoka County staff. Recommendations: Staff recommends that Resolution #88-220 be rescinded and that the proposed resolution be approved. Final plat approval of Bulow's Addition contingent upon the following: a. Mr. Bulow providing proof of marketable title for the property to the City. EOB approval of Ramsey's proposed amendment to the Critical River Overlay District Ordinance. Park dedication requirements shall be fulfilled in accordance with City Council's request for park dedication in effect at the time of the subdivision application which requires cash payment at the time of building permit issuance. in addition, the developer shall convey property rights to the City of thirteen (13) feet which will be on the South side of the right-of-way of Front Street Northwest and the remainder of the park dedication to be fulfilled by a cash payment. This conveyance of property rights shall be for the trail corridor. d. The developer shall enter into a development agreement with the City. Council Action: Motion to adopt resolution #88-__, approving/denying to rescind resolution #88-220 and final plat of Bulow's Addition with contingencies.
