Ms. Beth Neuendorf
Octobel: l 5, 2004
P~ge 2

d~e process of obtaJ~4ng a written statement, but have'been in contact with experts in ~lie ttn2c -!ring
industt? who have told us that a U~mrn at SUnfish would nOt'be a Safe maneuver. Pro SPorting Goods
estin~ates that they have '150 tracks that would have to make this maneuver annually. Anchors Aw~y
. has an esm2ated 1,200-1,400 RV's (many towing vehicles), that utilize thei~ oversize car wash bays.
Cur~endy, these vehicles utilize the FddsPar crossing. Closing it would ~ignificandy reduce business
and cause unsafe U-turns at Sunfish Lake Boulevard. '

3. At the m2enng, Beth Neuendorf indicated that it was safer for Pro Sporting Goods"customers to
merge onto Highway 10, sl0w'down, p~rform a U-mm on crossing RP 221.842, andaccelerate back
towards Anoka than to cross at Feldspar. This Claim assumes a merge maneuver is safer than a: freeway
crossing maneuver. However, we believe you failed to consider that a customer exiting the business
~.nd head&qg north would have to-merge into ~affic, then cross lanes, and decelerate, cross the freeway
and merge onto Highway 10 heading_south towards An0ka. It is inconceivable that' ~Vo merges and- a
slow-down would be safer than one crossing. In fact, the traffic accident statistics currend}; reflect no
serious injuries over the test period.in the DOT report at Feldspar. This is sigmificantly better than
many of the other crossings, including all of the controlled mtersectiohs that you have on th~ map (see
Exhibit One).

In short, by elh~2mamlg the crossing at Feldspar, we believe the City/state is moving ~oward condemnation of
dxe property. If that ii the case, steps should be 'taken to compensate the business owners that are locat,ed
.there.

In addition, public da~a being utilized to evaluate' these closings does not accutately reflect the safety .of these
, crossings. We ~vanted to issue dzis letter as quickly'as possible as ~ve continue to review dzis matter ~vith legal
counsel.

james D. Deal, cEO
NAU COMPANIES

Matt Kuker, President
PRO SPORTING GOODS, INC.

Jeff Deal, President
ANCHO RS AWAY
