Case #1: <br /> <br />Request for Final Plat Approval of Birch Lodges; Case of Orrin Thompson <br />Homes <br /> <br />Associate Planner Wald stated that Orrin Thompson Homes has applied for final plat approval of <br />Birch Hill Lodges. The applicant was proposing to develop 84 townhome units. The property is <br />generally located south of Sunwood Drive and west of T.H. #47. The property is approximately <br />14.08 acres in size. The 2001 Comprehensive Plan designates the subject property for medium <br />density residential development. The City Council approved a rezoning of the subject property <br />fi'om B-I Business to R-3U on January 22, 2002, which allows the property to be developed to a <br />net density of seven units an acre. Net density for the development has been established at six <br />units per acre. The final plat will be recorded at Anoka County as a Common Interest <br />Community (CIC). Therefore the final plat submitted to the City does not show each individual <br />townhome lot (building pads). The final plat submitted to the City consists of eight large lots, <br />Outlot C, Outlot B, and Outlot A. The final plat will be revised to show that Outlot A will be <br />dedicated as a park instead of an outlot. The dedication page should also reflect that the park <br />will be utilized for public purposes. The developer will record each townhome lot at the Anoka <br />County Surveyors Office when the construction of the units has either commenced or been <br />completed. The proposed townhome structures are required to comply with the preliminary plat <br />and site plan approved by the City Council on December 18, 2002. Cobalt Street is proposed to <br />be extended through the plat from Sunwood Drive to the southern boundary line of the plat <br />(abutting the Lord of Life property). The grading plan indicates that the applicant will need to <br />obtain a grading easement fi'om Lord of Life Church. Discussions have occurred between Lord <br />of Life and Orrin Thompson and both parties seem amenable to working out an agreement that <br />would allow Orrin Thompson to perform grading onto a portion of the Lord of Life property. If <br />Orrin Thompson Homes and Lord of Life cannot reach an agreement, Orrin Thompson Homes <br />will be required to construct a retaining wall along the southeastern boundary line of the plat to <br />achieve the proposed grading plan for the development. In conjunction with final plat review, <br />the City Engineer has reviewed the final grading, construction, streets, and utility plan. The <br />project is subject to the review and permitting process of the Lower Rum River Watershed <br />Management Organization (WMO). The Developer received the required WMO permit on <br />February 21, 2002. <br /> <br />City Attorney Goodrich stated that there was still a fair amount of documentation that the City <br />needed to receive since it will be a CIC development. He stated that he wanted to review all of <br />those documents to make sure that they are consistent with City ordinances and policies as well <br />as make sure that the City will have veto power over dissolution of the association. <br /> <br />Councihnember Hendriksen questioned if they shouldn't state that dissolution of the association <br />shall not be allowed. <br /> <br />City Attorney Goodrich replied no, explaining that there might be a different type of an <br />association they might want to establish over the years. <br /> <br />City Council/April 9, 2002 <br /> Page 6 of 14 <br /> <br /> <br />
