Mr. Lepper explained that they plat the development as condominiums not as townhomes, which <br />is why they do a CIC community. From paint to paint is what the homeowners own and even <br />though a CIC development can be a townhome community, it is a lot tighter method of managing <br />the site. <br /> <br />Councilmember Anderson inquired if an owner would be allowed to rent out their unit. <br /> <br />Mr. Lepper replied no, explaining that the units calmot be rented to the open market. <br /> <br />Councilmember Hendriksen inquired if the plat has been amended to comply with the City <br />Engineer letter dated April 5, 2002. <br /> <br />Associate Planner Wald replied that the applicant is willing to present a revised final plat <br />reflecting the comments of the City Engineer. <br /> <br />Councilmember Anderson noted that the City Engineer's letter does not state if the driveway <br />grade is acceptable or not. <br /> <br />Associate Planner Wald replied that she could not answer that question. <br /> <br />Councilmember Zimmerman stated that the plat proposes to have letter named streets, but do <br />they need to have number streets for public safety reasons. <br /> <br />Director of Public Works/Fire Chief Kapler replied that the way the streets are laid out it would <br />be appropriate to have numerical streets, but he requested time to research the issue. <br /> <br />Councilmember Hendriksen stated that many times the Council reviews things and approves <br />them contingent upon the City Engineer letter and in this case, the letter does not say the 10 <br />percent driveway approach needed to be resolved so if they approved contingent on the letter <br />they would be hard pressed to say that they had to resolve the issue. He requested that staff <br />express to the City Engineer that he has to draft letters with more specificity. <br /> <br />Councihnember Kurak stated that she would like to have a letter of intent from Lord of Life that <br />would state that the development and Lord of Life have come to an agreement. <br /> <br />Associate Planner Wald replied that staff did receive a letter stating that they are agreeable to <br />working something out. <br /> <br />Councilmember Kurak stated that she would like to see something in writing that they have <br />worked something out. <br /> <br />Mr. Lepper stated that they would prefer to receive final plat approval and then bring in all the <br />final documents. <br /> <br />City Council/April 9, 2002 <br /> Page 8 of 14 <br /> <br /> <br />
