Voting No: None. <br /> <br />Case #2: <br /> <br />Adopt Resolution to Amend River Pines 4th Addition Development <br />Agreement <br /> <br />Associate Planner Wald stated that on May 19, 1998, the City granted final plat approval of <br />River Pines 4"' Addition. Part of the development agreement required that the intersection of <br />158"~ Avenue NW and Potassium Street NW be gated to restrict through traffic to emergency <br />vehicles only. In addition, the Developer was required to deposit $1,500 with the City to defray <br />the costs associated with gating the intersection. On November 1, 2001, the developer (Orrin <br />Thompson Homes) issued a letter to the City of Ramsey requesting that the requirement to gate <br />the intersection of 158"' Avenue and Potassium Street NW be waived. The basis for the request <br />was the feeling that the restricted intersection would be a traffic hazard, impede emergency <br />services, and serve to divide the neighborhood. On February 19, 2002, the City Council Public <br />Works Committee met and considered the request to eliminate the requirement to restrict the <br />intersection of 158th Avenue NW and Potassium Street NW. A motion was passed to <br />recommend that City Council eliminate the requirement for a gated intersection. On March 12, <br />2002, the City Council ratified the recommendation of the Public Works Committee. The City <br />Attorney advised staff that the decision to eliminate the gating requirement in River Pines 4t~' <br />Addition is an amendment to the development agreement and should be affirmed by resolution. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Resolution #02-04-093 <br />amending the River Pines 4"' Addition development agreement to eliminate the requirement for <br />the installation of a gate at the intersection of 158th Avenue NW and Potassium Street NW, and <br />to authorize the Finance Department to refund the deposit collected from the developer for said <br />installation costs. <br /> <br />Further discussion: Councilmember Zimmerman stated that it was a mistake to eliminate the <br />emergency access gate. The residents were told that they would have the gate and now the City <br />is going back on its word, which is not good public policy. Councilmember Hendriksen stated <br />that when he was a citizen and Council was proposing the gate he opposed it. The suggestion at <br />that time was to re-position two lots, which are currently not built on, but the answer was the <br />gate and now the gate is not going in. So now the citizens that were promised the gate will now <br />have the additional traffic they were so concerned about. Councilmember Zimmerman inquired <br />if there were any plans for an east/west street through the development because from 153~d <br />Avenue to 167"' Avenue there is no east/west roads.
