Councilmember Zimmerman stated that adopting the Lakeville rules and stating they will follow
them is probably misleading. He suggested discussing the issue further at a future work session.

COUNCIL INPUT

Councilmember Anderson inquired as to how..they can get the mixed-use discussion moving
forward as well as the grading and tree policy. What she had in mind for preserving trees is not
what is occurring in The Ponds development.

Councilmember Hendriksen replied that when someone has sat at the table for 14 years as a
commission members and three years as a Councilmember, you take the promises of the
developer with skepticism. They say what they have to say to get an approval and then end up
doing what they were originally going to do.

Councilmember Anderson stated that apparently some of the grading ordinances over the years
have caused what happened in The Ponds development, not the developer.

Councilmember Hendriksen replied that that will always be the story after the fact.

Councilmember Anderson stated that if they can make things better for the future she would like
to try.

Councilmember Zimmerman recommended having the Planning Commission look into a tree
preservation ordinance.

Councilmember Anderson replied that it is the Planning Commission's responsibility to consider
what is, but it is not their job to create all of the ordinances.

Councilmember Hendriksen stated that he remembers that the Planning Commission has written
many ordinances over the years.

Councilmember Zimmerman stated that they should get input from the Planning Commission
first.

Councilmember Kurak stated that the Plarming Commission is currently very busy and so some
assistance by the Council to get it started might not be a bad idea.

City Administrator Norman agreed that more trees went down in The Ponds development than he
envisioned. He explained that the City has a very strict grading ordinance and to change that
they would have to change other things as well. Some concerned residents are willing to work
on creating the necessary ordinances.

City Council/May 6, 2002
