initiate the conditional use permit. The stated reason for the delay in initiating the use is economic conditions in the recycling industry. The approved site plan for St. Terminals includes removal of all steel and chain link fence and encompassing the work yard with a 13 foot high concrete wall by September 30, 2002. The wall will provide 100% capacity screening and will be the base structure from which the storage bins will be constructed within the yard. Outdoor storage of containers and company trucks and the retail sale of timbers is proposed on Lot 2 (no activity is proposed for Lots 3 and 4). The City is also continuing to work with St. Paul Terminals for a possible future expansion and development of an all enclosed facility in the industrial park. The Planning Commission and City Staff recommended approval of the request for extension to June 26, 2003, to implement the conditional use permit and September 30, 2003, to complete the 13-foot concrete walls around the work yard. Councilmember Hendriksen stated that he has seen progress on the site, but it is not cleaned up and questioned if they really anticipated in proceeding with the business. City Administrator Norman explained that they are still in the process of cleaning the site and working out the details of an expansion project, but it has simply been a case where the economy did stall their plans for expansion. Staff was comfortable with granting the extension. Councilmember Hendriksen inquired if there was a proposed time line. City Administrator Norman replied that staff did offer more TIF assistance and they have agreed to work with staff to put together preliminary plans. Brad Martinson, St. Paul Terminals Attorney, stated that they are working on putting together some engineering drawings to make it more of an undercover facility. The steel and aluminum market is coming back and there is hope on the horizon. Mayor Gamec noted that definite progress had been made on the property and he would like to see that continue. Mr. Martinson replied that the property owners are very conscientious about the clean-up. Councilmember Hendriksen inquired if it was true that the clean-up process had not stopped. Community Development Director Frolik replied that they have spent a significant amount of money on the clean-up. Councilmember Zimmerman stated that he had no problem with the extension. Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to adopt Resolution #02-05-115 granting a one year extension to June 26, 2003, for the implementation of the conditional use permit for a recycling facility issued to St. Paul Terminals in Resolution #01- City Council/May 14, 2002 Page 26 of 36
