Mayor Gamec inquired if a person would still be able to fly the helicopter ifMnDOT granted the <br />permit. <br /> <br />City Attorney Goodrich stated that if MnDOT issues a license, that will not mean that a person <br />can lar~d the helicopter in the City if the Council adopts the proposed ordinance. Currently the <br />use of a helicopter is not a permitted use so he would take the stand that the use is illegal <br />presently. <br /> <br />Mayor Gamec replied that he would also take that position. <br /> <br />Councilmember Kurak agreed as well. <br /> <br />Councilmember Zimmerman inquired if the use could be permitted with a conditional use <br />permit. <br /> <br />City Attorney Goodrich replied that they could, but once the permit is granted and as long as the <br />conditions are met, the City cannot prohibit the use. <br /> <br />Director of Public Works/Fire Chief Kapler stated that they need to make sure that they are riot <br />restricting the use of helicopters for emergency purposes, mosquito control, highway patrol, etc. <br /> <br />Community Development Director Frolik replied that the proposed ordinances address those <br />issues. <br /> <br />Mayor Gamec stated that he did not feel that helicopter use should be permitted for personal use, <br />even if someone owns a 20 acre parcel. <br /> <br />City Attorney Goodrich inquired if the City could ban the use of helicopters altogether with the <br />exception of emergency use, police patrol, mosquito control, etc. <br /> <br />Community Development Director Frolik replied that she would have to research that <br />information further. <br /> <br />City Attorney Goodrich suggested that the Council direct him to determine if banning the use of <br />helicopters is a legal option. <br /> <br />Councilmember Hendriksen stated that if someone wanted to build a regional hospital they <br />would build a heliport immediately, but on the other side they are saying someone with a 40 acre <br />parcel should not be permitted to use a helicopter on their property. He stated that he would like <br />to see more research so that the regulations are not being punitive. <br /> <br />Mayor Gamec requested that the City Attorney research ultra-lights as well. <br /> <br />City Council/May 14, 2002 <br />Page 28 of 36 <br /> <br /> <br />
