Mayor Gamec inquired if a person would still be able to fly the helicopter ifMnDOT granted the
permit.

City Attorney Goodrich stated that if MnDOT issues a license, that will not mean that a person
can lar~d the helicopter in the City if the Council adopts the proposed ordinance. Currently the
use of a helicopter is not a permitted use so he would take the stand that the use is illegal
presently.

Mayor Gamec replied that he would also take that position.

Councilmember Kurak agreed as well.

Councilmember Zimmerman inquired if the use could be permitted with a conditional use
permit.

City Attorney Goodrich replied that they could, but once the permit is granted and as long as the
conditions are met, the City cannot prohibit the use.

Director of Public Works/Fire Chief Kapler stated that they need to make sure that they are riot
restricting the use of helicopters for emergency purposes, mosquito control, highway patrol, etc.

Community Development Director Frolik replied that the proposed ordinances address those
issues.

Mayor Gamec stated that he did not feel that helicopter use should be permitted for personal use,
even if someone owns a 20 acre parcel.

City Attorney Goodrich inquired if the City could ban the use of helicopters altogether with the
exception of emergency use, police patrol, mosquito control, etc.

Community Development Director Frolik replied that she would have to research that
information further.

City Attorney Goodrich suggested that the Council direct him to determine if banning the use of
helicopters is a legal option.

Councilmember Hendriksen stated that if someone wanted to build a regional hospital they
would build a heliport immediately, but on the other side they are saying someone with a 40 acre
parcel should not be permitted to use a helicopter on their property. He stated that he would like
to see more research so that the regulations are not being punitive.

Mayor Gamec requested that the City Attorney research ultra-lights as well.

City Council/May 14, 2002
