ORDINANCE NO. <br /> <br />AN ORDINANCE ESTABLISHING EROSION CONTROLS <br /> AND LIMITING THE SIZE OF MOTORS AND SPEED <br /> FOR BOATS OPERATING ON THE LOWER RUM RIVER <br /> <br />Anoka County does ordain: <br /> <br /> Section is hereby added to the County's Code of Ordinances <br />and shall read as follows: <br /> <br />Water Craft - Erosion - Lower ~um River <br /> <br />Section 1. <br /> <br />purpose. The limitations contained in this ordinance are <br />designed to prevent and limit the erosion which is <br />occurring to the banks and shoreline of the Lower Rum <br />River. Large motors on boats create wave action which is <br />eroding the shoreline, banks, and bluffs along the river <br />and is adverse to the public's interest in maintaining and <br />preserving the shoreline. Swimmers, people canoeing, <br />and other people using the river more passively are placed <br />in jeopardy by large boats and wave actions, and this <br />ordinance is designed to protect the health, safety, and <br />general welfare of the public. <br /> <br />Section 2. <br /> <br />Requlations. <br /> <br />ae <br /> <br />Motor Size. No person shall navigate, place, <br />maintain, or operate any boat, motor boat, or <br />watercraft of any kind upon the Rum River from the <br />Rum River Dam in the City of Anoka to Anoka County <br />Road 7 Bridge Westerly or Rum River Central Park <br />which is propelled by an internal combustion <br />engine having a size and power in excess of five <br />horsepower. <br /> <br />Speed Limit. No person shall navigate or operate <br />any boat or watercraft of any kind upon that <br />portion of the RumRiverdescribed in A. above at a <br />speed in excess of six land miles per hour. <br /> <br />Siqns_- Postinq. The Sheriff or County <br />Administrator shall provide for the erection of <br />signs at all public accesses and at other <br />appropriate locations along the Rum River to <br />inform operators of watercraft of the motor size <br />limitation and the speed limitation applicable to <br />this senSitive portion of the river. <br /> <br />Operation of watercraft with motors in excess of <br />that allowed by this ordinance or in excess of the <br />speed set forth in paragraph B is prima facie <br />evidence that the watercraft is being operated in <br />violation of this Ordinance. <br /> <br /> <br />
