Councilmember Kurak inquired if the $450,000 included the fees from the new developments <br />coming into the City. <br /> <br />Principal Engineer Olson replied that it did not include all of the new developments. <br /> <br />Councilmember Kurak inquired if staff was asking that they use the funds from the Stormwater <br />Management Fund for upsizing the pipe. <br /> <br />Principal Engineer Olson explained that the question is where do they go with the policy on how <br />the funds are used. The reason the issue was originally discussed was to see how the funds are <br />being used and possibly set up a formal policy regarding its use. The one uncertainty is projects <br />such as 149't~ Avenue where the City provided a storm sewer pipe to the Rum River north and <br />east of T.H. #47 and Sunwood Drive because of a serious drainage problem, whereas that was <br />paid for under the Stormwater Utility Fund but it also served the function of providing a positive <br />overflow for future development. The use of the funds depends on how the project is initiated. <br />On-site expenditures have been paid for by the developer, off-site have and have not been paid <br />for by the developer. <br /> <br />Councilmember Hendriksen stated that there needs to be some relationship of the cost that is <br />recovered to what is expended and suggested the possibility of sharing the costs. <br /> <br />Principal Engineer Olson replied that ultimately it is the Council's decision whether a <br />development is approved or not. <br /> <br />Councilmember Hendriksen stated that if every developer spends everything of what they <br />contributed and more, then the City will have to come up with money from some place else. He <br />stated that each developer has to draw less than what they contributed otherwise there will be no <br />funds. <br /> <br />Principal Engineer Olson stated that if developers always contribute more than the City spends <br />from the fund the City will always be gaining funds. <br /> <br />Councilmember Hendriksen inquired after the project is completed and the developer is out of <br />the picture, from that point forward would any additional costs come from the Stormwater Utility <br />Fund. <br /> <br />City Engineer Olson replied yes. He explained that the first time installation is done by the <br />developer and funded from the Stormwater Management Fund. <br /> <br />Councilmember Zimmerman inquired if staff determined if a developer has to provide the <br />ponding. <br /> <br />Principal Engineer Olson replied that ponding is determined by the WMO. He noted that the <br />City has had cases where a developer has used an existing wetland for the ponding requirement, <br />but the WMO has stated that they can no longer do that. <br /> <br />City Council/May 21, 2002 <br /> Page 2 of 8 <br /> <br /> <br />
