<br />. <br /> <br />. <br /> <br />. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Anderson, to approve the proposed site <br />plan for Evergreen Point contingent upon compliance with City staff review letter dated April 26, <br />2002, revised May 23, 2002, and final plat approval of Evergreen Point Townhomes and the <br />applicant entering into a development permit with the City and subject to the rezoning of the <br />property. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Anderson, and Kurak. <br />Voting No: Councilmembers Hendriksen, and Zimmerman. <br /> <br />Case #11 : <br /> <br />Adopt Ordinance to Rezone Property from R-l Residential, B-1 Business and <br />B-2 Business to R-3U Multi Family Residential; Case of Edina Development <br /> <br />Principal Planner Trudgeon stated that Edina Development has submitted an application to <br />rezone the property located in the northwest corner of Alpine Drive and Highway. #47 to <br />Multiple Residential to allow for a medium density residential development. The rezoning would <br />allow the applicant to build a townhouse development of 110 townhouse units. On February 12, <br />2002, the City Council adopted a Comprehensive Plan Amendment to change the land use <br />designation of the subject property from Places to Work to Medium Density Residential. The <br />Metropolitan Council, in a letter dated April 19, 2002, approved the amendment. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Ordinance #02-16 to <br />rezone the subject property from R-IR Residential, B-1 Business, and B-2 Business to R-3U <br />Multi-Family Residential. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Kurak aye <br />Councilmember Zimmerman nay <br />Councilmember Hendriksen nay <br />Councilmember Anderson aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Mayor Gamec requested that staff follow up on the mailbox policy to cluster all cul-de-sac <br />mailboxes. <br /> <br />Case #14: <br /> <br />Fire Works Moratorium <br /> <br />City Attorney Goodrich stated that a new law became effective April 29 that will permit the use <br />of some fireworks. The major concern of the Fire Department is the storage of fire works in <br />large quantities. Staff will be recommending that the Council require a license for the sale of fire <br />works as well as a licensing fee. <br /> <br />City CounciVMay 28, 2002 <br />Page 24 of 25 <br />
