Councilmember Zimmerman stated that he sees conditional rezoning as a tool for a developer to <br />present a plan and find out if they should proceed or not. <br /> <br />City Attorney Goodrich replied that they are talking more about performance standards rather <br />than specific uses. <br /> <br />Councilmember Hendriksen stated that as long as they understand that changing the land use <br />designation permits the landowner to the entire range of what is permitted, they can't guarantee <br />what will happen on the property; and if the developer has painted a picture of what will occur, <br />there is no guarantee that that is what will happen. <br /> <br />City Attorney Goodrich replied that that was true. <br /> <br />Councilmember Zimmerman stated that the contract would be a benefit to the developer. <br /> <br />Councilmember Anderson inquired if all rezonings would be conditional. <br /> <br />Councilmember Zimmerrnan stated that instead of a developer simply applying for a rezoning <br />the developer could bring in a plan and at that point the Council could agree with the plan or <br />disagree with the plan. <br /> <br />Councilmember Anderson stated that the point of the Comprehensive Plan is to identify <br />reasonable land uses. <br /> <br />Councihnember Zimmerman replied that the zoning would give a developer a use above what is <br />designated in the Comprehensive Plan. <br /> <br />Councihnember Anderson noted that in a commercial zone there is a range of uses. <br /> <br />Councilmember Zimmerman stated that conditional zoning would allow the City to see what <br />would be developed before the rezoning. <br /> <br />Councilmember Anderson replied that the problem is if the land is already zoned. <br /> <br />Counciimember Zimmerman replied that if the land is already zoned then the developer would <br />not have to come before the Council for a zoning change. <br /> <br />Consensus of the Council was to continue to discuss the issue further at a future Council work <br />session. <br /> <br />2) Mississippi West Regional Park Frontage System <br /> <br />City Attorney Goodrich presented the Council with a resolution adopted by the Council in 1996, <br />approving of the concept of the Mississippi West Regional Park. He also presented the County's <br />Mississippi West Regional Park plan. He noted that there was no discussion regarding additional <br />commercial development except for the frontage road in either document. <br /> <br />City Council/May 28, 2002 <br /> Page 5 of 6 <br /> <br /> <br />
