The ordinance as proposed would limit the sale of fireworks to businesses that have sprinkled <br />buildings. A $500 license fee was also included in the ordinance. <br /> <br />Councilmember Kurak inquired if there was any concern with fireworks being sold at a gas <br />station. <br /> <br />Director of Public Works/Fire Chief Kapler replied that the storage of the fireworks would be a <br />concern. <br /> <br />Mayor Gamec stated that he could somewhat agree with the sprinkling system requirement, but it <br />is a possibility that some of the major food chains, gas stations will want to sell fireworks and <br />that restriction might prevent those sales from happening. <br /> <br />Director of Public Works/Fire Chief Kapler replied that some cities have adopted an ordinance <br />pemfitting different amounts of inventory in a non-sprinkled building such as 50 lbs. in a non- <br />sprinkled building and 200 pounds in a sprinkled building. He noted that he was making the <br />assumption when writing the ordinance that the State of Minnesota will legalize more fireworks <br />in the future and if they were to get some sort of distributor in the City they would want to <br />readdress the sprinkling issue. <br /> <br />Mayor Gamec stated that he would like to see the 50 lbs. for non-sprinkled businesses be <br />permitted. <br /> <br />Councilmember Kurak inquired if the ordinance would eliminate firework stands and people <br />selling them out of the back of their pick-ups. <br /> <br />Director of Public Works/Fire Chief Kapler replied yes. <br /> <br />Councilmember Zimmerman inquired if the $500 fee was too high. <br /> <br />Director of Public Works/Fire Chief Kapler replied that at this time staff was not sure of the <br />stress it will place on staff and they want to make sure they cover their costs. <br /> <br />Councilmember Zimmerman stated that 50 lbs. does not seem like a lot so a business owner <br />might not bother. <br /> <br />Mayor Gamec replied that they could keep replenishing the 50 lbs., noting that it would be the <br />actual weight of product. <br /> <br />Councilmember Anderson inquired if other communities are limiting the storage by the amount <br />of weight. <br /> <br />City Council/June 4, 2002 <br /> Page 2 of 4 <br /> <br /> <br />
