Director of Public Works/Fire Chief Kapler replied yes. He noted that staff could add language
that sprinkled buildings can store fireworks up to 200 pounds and un-sprinkled buildings could
store fireworks up to 50 pounds.

Councilmember Hendriksen inquired if the sporting good stores along Highway #10 are
sprinkled.

Director of Public Works/Fire Chief Kapler replied that both sporting good stores are sprinkled.

Councilmember Hendriksen inquired as to what the City's regulations are for gunpowder and
ammunition.

Director of Public Works/Fire ChiefKapler replied that addresses those issues.

Councilmember Hendriksen stated that he was talking about ammunition and raw gunpowder.

Director of Public Works/Fire Chief Kapler replied that he would have to research that
information.

Councihnember Hendriksen stated if the City is going to let a business have 100 pounds of gun
powder, then 200 pounds of sparklers might not be that bad. He did not think that the City
needed to be overly cautious simply because it is a new thing because there are probably a lot
more explosive things in the City.

Director of Public Works/Fire Chief Kapler replied that the difference is that fireworks are
designed to explode.

Councilmember Hendriksen noted that so was gunpowder.

Director of Public Works/Fire Chief Kapler replied that that was true but the container that holds
the gunpowder is not. The concern is if fireworks are unregulated they might have a homeowner
that is selling out of their garage and that could be a real problem.

Councihnember Hendriksen agreed that they don't want tents along Highway #10, but wants to
keep things in perspective.

Councilmember Anderson inquired if it was likely that there might be fireworks stands set up for
the 4th of July function at Diamonds Sports Bar.

Mayor Gamec replied that they would have to comply with the ordinance.

Councilmember Hendriksen inquired if Diamonds were to comply with the ordinance to sell
fireworks, does the ordinance state that they would have to sell the fireworks inside the building.

City Council/June 4, 2002
