Consider Offer to Purchase Drainage and Utility Easement from Lot 1, Block 3 <br />White Pine Estates <br /> <br />Assistant Public Works Director Olson reviewed that the City recently completed Improvement <br />Project #04-24 that corrected a drainage problem, which had existed in the vicinity of 169th <br />Avenue and Helium Street. In :order to facilitate this project it was necessary to obtain a <br />drainage and utility easement along the northerly property line of Lot 1, Block 3, White Pines <br />Estates. The property owners of this parcel signed a Right of Entry agreement to allow this <br />project to proceed while an appraisal of the value of the easement could be established. An <br />appraisal has been established in the amount of $5,200. This matter was discussed with the <br />Public Works Committee to receive aUthorization to make the offer. Since the Public Works <br />Committee, the property owner has seen the appraised value and wishes to accept this as the <br />value of the easement. Staff recommends authorization be granted to release the funds of <br />$5,200 to purchase the property. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Kurak, to ratify the <br />recommendation of the Public Works Committee in Case No. 5 and authorize staff to release <br />the {'unds ($5,200) to purchase the property. <br /> <br />Motion carried. Voting Yes: Mayor Pro Tern Zimme~Tnan, Councilmembers Cook, Kurak, <br />Elvig, and Pearson. Voting No: None. Absent: Mayor Gamec and Councilmember <br />Strommen. <br /> <br />6) Consider Offer to Purchase Trail Easement on Geving Property <br /> <br />Assistant Public Works Director Olson informed the Council the appraisal for the trail <br />easement on the Geving Property was determined at $6,200. The property owner countered the <br />offer at $8,000. Staff recommends acceptance of the counter offer at $8,000. Staff is also <br />recommending that the City Attorney review the easement document and make the necessary <br />modification to allow the septic system to:remain within the easement until such time as it <br />needs to be replaced or the structure is connected to City sewer. <br /> <br />Mayor Pro Tern Zimmennan questioned if the agreement will include wording that the property <br />owner will maintain the drain field and that the easement will be gone when there is hook up to <br />City sewer and water. <br /> <br />Assistant Public Works Director Olson responded in the affirmative. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to ratify the <br />recommendation of the Public Works Committee in Case No. 6 and accept Ms. Geving's <br />counteroffer, and that the City Attorney review the easement document and make the necessary <br />modification to allow the septic system-to remain within the easement until such time as it <br />tmeds to be replaced or the structure is connected to City sewer. <br /> <br />City Council/December 14, 2004 <br /> Page 19 of 33 <br /> <br /> <br />
