The consensus of the Council was to recess the meeting to allow staff to determine language to <br />address the required findings of fact limiting the queuing to four stalls. <br /> <br />Mayor Pro Tern Zimmerman recessed the meeting at 8:43 p.m. and reopened the meeting at <br />8:57 l).nl. <br /> <br />City Attorney Goodrich suggested the ~addition of the following finding of fact: The proposed <br />use would impact the traffic pattern in the immediate vicinity and as result it is necessary to <br />limit the queuing of vehicles in the drive-up window. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Cook, to adopt Resolution <br />#04~12-387 adopting Findings of Fact #0711 relating to Ramdance, LLC's request for a <br />Conditional Use Permit to operate a drive-thru feature on the Pond Building on Lot 1 of <br />Ramsey Town Center 3''~ Addition, with the following additional finding of fact: <br /> The proposed use would impact the traffic pattern in the immediate vicinity and as <br /> result it is necessary to limit the queuing of vehicles in the drive-up window. <br /> <br />Motion carried. Voting Yes: Mayor Pro Tern Zimmerman, Councilmembers Kurak, Cook, <br />Elvig, and Pearson. Voting No: None. Absent: Mayor Gamec and Councilmember <br />Strommen. <br /> <br />City Attorney Goodrich suggested the following additional permit conditions: <br /> · The permit use is for coffee shop type of uses only, which requires minimal drive up <br /> queuing uses, and shall not include fast food. <br /> · The traffic pattern for the use shall be designed to prohibit the queuing of vehicles to no <br /> more than four vehicles from the menu station back. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Kurak, to approve the request <br />tbr Ramdance, LLC for a Conditional Use Permit for a drive-thru feature on the Pond Building, <br />based on the findings of fact, and adopt a resolution declaring terms of same, with the <br />following additional conditions, and with authority for the City Attorney to draft the conditions <br />into better language: <br /> · For coffee shop type uses, which require minimal drive up use and will not include fast <br /> food restaurants. <br /> · The traffic pattern for the use shall be designed to prohibit the queuing of vehicles to no <br /> more than four vehicles from the menu station and back, except the queuing of more <br /> than four vehicles shall be permitted during 10 percent of the establishment's operating <br /> ho[irs. <br /> <br />Further discussion: Councilmember Elvig asked if the applicant is comfortable with the <br />additional finding and conditions. Mr. McDonald replied there is not a problem with most of <br />what has been stated.
