The consensus of the Council was to recess the meeting to allow staff to determine language to address the required findings of fact limiting the queuing to four stalls. Mayor Pro Tern Zimmerman recessed the meeting at 8:43 p.m. and reopened the meeting at 8:57 l).nl. City Attorney Goodrich suggested the ~addition of the following finding of fact: The proposed use would impact the traffic pattern in the immediate vicinity and as result it is necessary to limit the queuing of vehicles in the drive-up window. Motion by Councilmember Kurak, seconded by Councilmember Cook, to adopt Resolution #04~12-387 adopting Findings of Fact #0711 relating to Ramdance, LLC's request for a Conditional Use Permit to operate a drive-thru feature on the Pond Building on Lot 1 of Ramsey Town Center 3''~ Addition, with the following additional finding of fact: The proposed use would impact the traffic pattern in the immediate vicinity and as result it is necessary to limit the queuing of vehicles in the drive-up window. Motion carried. Voting Yes: Mayor Pro Tern Zimmerman, Councilmembers Kurak, Cook, Elvig, and Pearson. Voting No: None. Absent: Mayor Gamec and Councilmember Strommen. City Attorney Goodrich suggested the following additional permit conditions: · The permit use is for coffee shop type of uses only, which requires minimal drive up queuing uses, and shall not include fast food. · The traffic pattern for the use shall be designed to prohibit the queuing of vehicles to no more than four vehicles from the menu station back. Motion by Councilmember Cook, seconded by Councilmember Kurak, to approve the request tbr Ramdance, LLC for a Conditional Use Permit for a drive-thru feature on the Pond Building, based on the findings of fact, and adopt a resolution declaring terms of same, with the following additional conditions, and with authority for the City Attorney to draft the conditions into better language: · For coffee shop type uses, which require minimal drive up use and will not include fast food restaurants. · The traffic pattern for the use shall be designed to prohibit the queuing of vehicles to no more than four vehicles from the menu station and back, except the queuing of more than four vehicles shall be permitted during 10 percent of the establishment's operating ho[irs. Further discussion: Councilmember Elvig asked if the applicant is comfortable with the additional finding and conditions. Mr. McDonald replied there is not a problem with most of what has been stated. However, they should be careful when stipulating a queuing of four, as there could be occasional occurrences of queuing higher than four. City Council/December 14, 2004 Page 24 of 33
