Miller, Inc. in the amount of $364,002.53. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to adopt Resolution <br />02-06-141 awarding Division A of the 2002 Street Maintenance Program to Allied Blacktop in <br />the amount of $162,601 and adopt Resolution 02-06-142 awarding Division B of the 2002 Street <br />Maintenance Program to W.B. Miller, Inc. in the amount of $364,002.53. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendriksen, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Mayor Gamec asked when the project will be initiated. <br /> <br />City Engineer Jankowski stated it will be initiated after July 4, and notice will be sent in <br />September of the final costs, with the hearing held at the second meeting in September. <br /> <br />Case #9: <br /> <br />Consider Introduction of Amendment to Ordinance Regarding Decorum and <br />Order <br /> <br />City Administrator Norman reviewed that during a Council Work Session on May 6, 2002, the <br />City Council directed staff and the City Attorney to draft language regarding decorum and order <br />during City Council meetings. Amendments have been drafted which will be added to Chapter 2 <br />of the City Code of Ordinances under the section dealing with presiding officers. The primary <br />additions deal with decorum and order for Councilmembers, decorum and order for the public, <br />and enforcement of decorum. City Administrator Norman presented the draft language which <br />was included with this case for Council review. <br /> <br />Councilmember Hendriksen questioned Subdivision 3, Appeal of Presiding Officer Ruling, that <br />indicates no other Councilmember shall participate in the discussion. He suggested it indicate <br />the person making the objection be allowed to fully state the objection. <br /> <br />City Administrator Norman stated that section of the ordinance is part of the current code and not <br />being amended tonight. <br /> <br />Councilmember Hendriksen stated he believes this subdivision does not work and would support <br />it be amended to state: "Any member may appeal to the council from a ruling of the presiding <br />officer. The member must clearly state their objection. If the appeal is seconded, the presiding <br />officer may explain his/her ruling." He suggested that the words "but no other council member <br />shall participate in the discussion" be deleted. <br /> <br />City Attorney Goodrich stated he finds this suggested revision to be appropriate language. <br /> <br />City Council/June 11, 2002 <br />Page 13 of 30 <br /> <br /> <br />
