Councihnember Hendriksen asked what "personal privilege" means in Section h. <br /> <br />City Attorney Goodrich stated it allows the member to have the floor to explain the subjects <br />indicated, "his or her integrity, character or motives has been assailed, questioned or impugned" <br />if being attacked by a fellow councilmember. <br /> <br />Councilmember Hendriksen asked if you would have to be recognized to do that. <br /> <br />City Attorney Goodrich stated you would need to be recognized. He stated this language is fi'om <br />the Lakeville code. <br /> <br />Councilmember Zimmerman stated that under normal circumstances this may be a good <br />procedure but in the long run he believes it will discourage the freedom of speech by different <br />members. He stated he does not know that the present system is "broke" or needs to be fixed. <br /> <br />Mayor Gamec stated that fi'eedom of speech would not be reprimanded but you can consider how <br />to treat each other. <br /> <br />Councihnember Zimmerman stated that may not be the case in practice. <br /> <br />Councilmember Anderson stated this may keep the City out of a law suit since it would be clear <br />that under the ordinance the City does not condone that type of behavior. <br /> <br />Councilmember Kurak stated she supports this revision and believes it is common courtesy and <br />kindness. She stated these are generic courtesy rules and not extraordinary so she has no <br />problem following any of them. <br /> <br />Councihnember Hendriksen stated he also finds this to be a positive document. He stated that he <br />has often been on the side of a minority position and does not feel that the minority position has <br />been respected or the opportunity provided to be fully heard. He stated he hopes this policy <br />provides a better opportunity to state your case and fully discuss the issues on the table. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Anderson, to approve the <br />introduction of an Ordinance to amend Section 2.01.02 of City Code which section is entitled <br />"Presiding Officer" as revised in Subdivision 3. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson, and <br />Kurak.
